Why thank you. I didn't think anyone would miss me. But I am only back for a few weeks and then it is back off into the fray. It seems perverse to mention it but I am on my three months compulsory leave!

3 months hey! Not bad, if you can what type of work is it?

You accrue holiday when on holiday (each hour paid accrues some holiday hour). But the OP's wasn't a holiday, it wasn't typical leave and wasn't part of any leave already accrued. Holiday hours are pro-rata.
You don't accrue holiday when on holiday that's where the 12.07% figure comes from you work 46.4 weeks of the year 12.07% of that is 5.6 weeks which equates to 28 days. You only accrue leave when working or credited with working.

I suppose it now comes down to what it says in the contract does it say that when an employee is on unpaid leave they do not accrue annual leave?

I've seen clauses in contracts that say when an employee is off work on strike then an adjustment will be made to annual leave as well...otherwise an employee could go on strike for 11.6 weeks (11 weeks and 3 days) then have 1.4 weeks (1 week and 2 days) off work fully paid and that wouldn't be right would it.

:p Regular savers earn 6% interest (HSBC, First Direct, M&S) :p Loans cost 2.9% per year (Nationwide) = FREE money. :p
