Motormile DCA - advice needed!

Hi all

I was wondering if I could ask for advice - I looked on previous threads but they didn't contain the same type of information.

For the past 3 days my OH has been incessantly contacted on his mobile only by MotorMile DCA - no letters through the door, no information of the value of the debt and now they are saying (when the OH listened to one of the voice messages) they are sending a bailiff round. :mad:

Now - am I correct in saying that if we do not have anything in writing (i.e. a letter) they cannot send anyone round as they haven't even confirmed that we are the 'owners' of this debt as they claim?

Does anyone know how is best to progress.

My thoughts were:
1) send them an email (cause its instant) stating not to contact us via phone, to only contact via letter
2) to request them to send us a letter stating the details of the debt they have supposedly been sold - who sold it to them or the value of the debt (so we can see - we have got a few outstanding! :eek:)
3) request no one comes to the door as they have no right to do so - as we don't even know what debt this is about so seems a bit premature.

Surely a DCA can't consider phone calls and SMS as a proper way to conduct business even if some DCAs are at the bottom of the food chain and are just pure evil!!!

    Do you have a debt that it could be?

    Only a bailiff if you had a CCJ and you hadn't paid, but usually put in writing first I would think.

    I'm sure an expert will be along soon....

  • thanks happy_bunny - do you know if prove it letters are still valid if sent via email?

    I'm thinking - letters take so long (more than a few minutes!!) and all these calls are stressing the OH out?

  • Don't email! Written and signed for gives you proof you sent it, an email can always be 'lost'. See happy_bunny's signature!

    Send it via email and then follow up by post.

    Don't sign it, they might lift your signature for something.

  • do you think it is best to do this straight away or wait until they try and get in contact via letter?

    Have been scouring the internet and MotorMile seem to be right b*stards when it comes to phone/text harassment - afterall they have no legal right to attend our property and if they haven't sent us a letter they might not even know where we are!!

    PS - we are planning to pay off this debt - I just don't like these bullyboy tactics and want to pay when I'm ready (ie next month) not now when it could cause more problems!

    Ignoring them is also an option.

    If they are serious they will write, and you are correct, you may just give them a bite with your address

  • hmmm - i wonder if its worth waiting but if they call again we answer telling them we will not communicate except in writing - or will they not need to uphold that because it was over the phone?

    Yes they are :)

    I wouldn't talk to them, they will tell you all sorts of stuff they would not dare put in writing.

    If not too much hassle, ignore the calls and send the prove it should any letter arrive.

    Doubt anyone will be round, and if they do just tell em to sod off.

    I'll just tell OH not to answer his phone to them and we'll deal with the letter if/when it arrives!!

    Fingers crossed we don't have to deal with them further down the line!!!!!!!
