David Lloyd - ARC Europe LTD - Scotcall

Read alot on this forum about these companies which has been very helpful, but getting fed up with it all now as it seems none of the companies listen.

I'm sure most of you have heard this before so will keep it as simple as possible.

In a nut shell I was a member at David Lloyd gym for over 6 years. I was last year made redundant and at the time Lloyds had notified me of impending membership fee increases to £95 a month, so I decided to cancel my membership. Discussed my situation with the David Lloyd team and said I could suspend my membership for 3 months and if my circumstances improve, reinstate it or cancel it at the end.
Within the suspension period I notified them that I wanted to cancel my membership at the end of the suspension, but they then said I had to pay 3 months full membership. I argued this is not what I was told, nor was discussed and refused to pay. After being a member for over 6 years it was very poor service and I felt very under valued after being a very loyal customer. As I was also in arrears at the time still from my redundancy, they agreed that if I sent a copy of my bank account statement in as proof that I didn't have sufficient funds to pay they'll write off the cancellation fee.

I sent every correspondence to both my local club and head office by recorded mail so I know they received my letters and statements.

Despite this I was hounded by phone calls from Lloyds accounts people where I constantly explained the situation again and again, constantly being told they'll 'update their records' to remove the debt.

Eventually started to get contact from ARC and now recently Scotcall threatening to send people round for a visit.
Again, hounded with calls and letters, some I've ignored and others I've responded too with copies of the Lloyds correspondence saying the debt is in dispute with Lloyds and myself and should of also been settled by now etc etc. using templates on here but still they keep coming!

Bit sick of it now. Anyway of stopping this constant harassment before it gets passed onto another company?

    Hi,

    Nightmare....

    Write to Scotcall, telling you will deal with them in writing only.

    Do they own the debt, or are they collecting on behalf of David L?

    If owned by Scotcall:
    Then make a formal written complaint to Scotcall that the amount being claimed is disputed and that the debt should have not been sold with the account in dispute.

    If owned by David L:
    make a formal written complaint to Scotcall that the amount being claimed is disputed and that the debt should not be collected until this dispute is resolved.

    Realistically, they are trying to bully you into paying as they have to take you to court to make you pay and as long as your story checks out they have no hope of winning and they will know that.

    Keep a record of everything sent and received.

    Do you have a copy of tour terms and conditions?

    Their website says their complaints process is only available from the members area. Was wondering who if anyone you could refer complaint to.

    You could of course threaten them with trading standards and the OFT.
