Can i get a refund on a deposit for Optical Express

Hi, I put a deposit down of £400 for laser eye surgery about a year ago. Due to personnel situations, iv had to put back final payment and the procedure time and time again. Now I am wondering if i can get this deposit back after the amount of time passed?

Advice please

Dave

I doubt it usally a deposit is to protect them incase you don't go ahead.

But what do I know? :D
People don't know what they want until you show them.

A deposit paid confirms a contract mutually agreed for you to receive the service in return for the the full payment. If you want to now break that contract, then they can sue you for the full amount-not just for the deposit. But in reality they'll probably just retain the deposit.
You can certainly ask for it back , but I'd rate your chance as zero.

Surely the whole point of a deposit is that is it put down as part payment and security that the full balance will be paid. Otherwise whats the point?

It's also to confirm the contract as valid. For a contract to exist there must be a 'consideration' made (in this case some cash) in exchange for goods and service, or the promise of them in the future.
The amount could be 1p. But there needs to be something.
