Letter Before Action from Parking Eye

Hello
My husband has just received a Letter Before Action from Parking Eye today although he was not the driver. I was the driver and overstayed very slightly at The Range because my baby had a number 2 just before we had to leave which had gone up all her back so I had to change her. My other daughter who was three at the time also needed a number 2 whilst in the toilet and could not reach by herself and therefore had to wait until I had finished cleaning up my baby. After reading info from this site we decided to ignore the previous letters from Parking Eye and hope they would give up as I thought they would never believe why I was late back to my car and didn't really know how to write an appeal that involved my children's bodily functions. I ate in the cafe with the children but paid for this in cash and so don't have proof but also bought over £60 pounds of goods which I can prove as I paid by card.
I am really really stressed by all of this but do not want to pay them £100 pounds for overstaying in that car park for a very short amount of time and for a genuine reason.
Please do you have any advice for me.
Thank you

You have a number of options on this, the one I would do in your place is get the RK your husband to name you as the person responsible for the vehicle on this day, ensure you keep it that you don't actually name the driver, ensure he supplies the address as well.
I know it sounds daft as you live in the same house, but this resets the clock back to the notice to keeper stage, then you can appeal with your proof of shopping, if they reject you can appeal to popla.
You can win this there with our help. If they continue to the small claim despite knowing who the keeper of the vehicle on the day they probably be done for contempt. Ensure you email and post a letter to them with proof of postage that you can get for free from the post officeWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

And use something like this
Ref:
Date
Hello Parking Eye
I as the registered keeper are in receipt of your letter before claim dated xxxxx, as I was not responsible for the vehicle on this day, I wish to inform you of the keeper on the day in question
Name
Address
Now that I have discharged my liability in accordance to the Protection of Freedoms Act 2012, this matter is now closed. If you continue your spurious claim against me I will defend it in full.
Sincerely

Thank you so much for your advice so far. I have had a knot in my belly all day and know that I will not sleep tonight. Do you think I should contact the store manager to try and get them to get rid of this fine or not? If I do contact the store manager would I be ok to give them my name or not?
Thank you0 -
Normally I would say Yes but this is the Range and the owner is a Del Boy in league with the PPC so a waste of time.0

I see a lot of posts about charges originating from the car park at "The Range". When will people unite and go somewhere else. I know it's not easy if there are no other stores near to you - but you should vote with your feet, this is the MSE forum and we are meant to be questioning and thoughtful as consumers.0

I would still complain to the range nonetheless , try and get the local press involved as well if you really want to kick them somewhereWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Should I contact the store in writing or by telephone?
In terms of where I shop I definitely will be avoiding The Range and any other store that uses Parking Eye in particular when ever I can. In addition I will never ever eat at a store again where they have a limited time to park especially with children. I will also if necessary contact the local press if I have to pay this fine as I do not know any parent who would have done anything different to what I had to do in that situation.

Writing is better, emails the best I think in cases like thisWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Thank you Stroma. Should I write the email from my husband or from myself and explain what happened? I'm worried that The Range could pass the information onto Parking Eye and then they would know that I was driving the car which would make it easier for them to go after me directly.
I know that you can't make this go away but I really appreciate you responding to my messages as I think I would have caved in otherwise.0
