Probably nothing to do with the probation, just that you haven't "earned" the holidays by your short term of employment.0

I took 5 days off they saying they don't pay holiday pay why on probation, my bosses word, they have said I haven't earned enough but ive earned 3 days,so why didn't they pay me for that if that was the case0

In my view they should pay you for the 3 days. However, if you asked me the question 'can an employer refuse paid holiday within the PP?' I suspect they can. They would be within their rights to refuse any leave requested within the first 3m (since they can dictate when you take yr leave) - what they have done is a bit of an improvement on this. since they (presumably) allowed you to take the time off.
What is clear is that these 3 days remain yours. You should be allowed to take them later in the leave year, and if you leave within the LY you should be paid for them.Ex board guide. Signature now changed (if you know, you know).0 -

If they're not paying you, then you have taken unpaid leave, not holiday, and you will still have your full holiday entitlement for the year!
How long is the probation period?Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

Disagree, they should only pay if it wasn't clear before the holiday was booked. If they made it clear that it was unpaid leave during probation then the OP should have known.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0
