CSA made a mistake....REALLY!

    That is correct yes, I am a Director. Strangely the CSA did ask me for the dividends, which I immediately sent, then never took them into account.

    If that is the case, then if my ex-wife suddenly asks for a Variation will it be backdated or is it from the date she asks?

    Do they actually pay money back if you've paid too much? Or do they view it as you decided to pay more than you needed and that was your choice.??

    I think it depends on the circumstances, generally they'd view that as paying in advance, and would usually readjust your schedule to take that into account. Their system isn't set up to charge more than whatever the weekly amount is, I remember a few NRPs who wanted to pay more than their assessment, but CS2 doesn't work like that. Anything received over and above the ongoing maintenance is allocated to the next week.

    If she applies within 4 weeks of an assessment it will be backdated to the effective date of that assessment - not sure I've explained that very well. If she applies for a Variation more than 4 weeks from an earlier assessment, the effective date will be the date she applied. I don't understand why you wouldn't expect to pay maintenance on all of your taxable income? I suggest you put to one side the appropriate percentage of your Dividend so you do not build up arrears.
