Capquest help

Hi all

I have a credit card debt with Santander and couldn't afford the monthly repayments as I was self employed with a failing business. The card limit was 5k which I reached. I did always make token payments. I closed my business and got a job, first salary Santander went in and took nearly all of it leaving me unable to pay rent etc and family had to bail me out. I contacted them at the time and said there was nothing they could do and the debt had been passed on. I contacted the company they said it had been passed on to but they had no record and said I should keep checking in until they had details . In disgust I changed banks and left my old address. A week ago I had a letter from capquest saying the debt had been "referred" to the for £6250. I have heard all sorts of things about these people and wonder how to proceed template letters wise. The debt is a few years old but not six and I'm working part time with a partner and bsby and other debts so could only afford 20-30 a month repayment max can anyone help on how to proceed .     I have dealt with Capquest, they phoned and sent letters which I ignored, but eventually faced up to the fact that I did owe the money. The debt I had was a Capital one card. When I phoned them I was in a strong position as I had been paying random amounts and each time they sent me a letter I could see the debt owing had gone down due to the payments I had recently made.

    I offered £50 a month, but the person I spoke to said the minimum amount was £74 pm, a bit steep but I agreed to it. She wanted me to make a payment there and then I said no as about a week before I had paid £50. A date for payment (after payday) was agreed and they sent me a letter to confirm the details of the agreement. After that I had no further contact with them e.g phone calls or letters. I paid each month via their website, never missed, made a partial or late payment at times it was hard to find that money and galling to have to pay that debt off first. I got a PPI refund on the CC which they applied to the account and I made my last payment in June this year. Thankfully that is now paid off.

    A colleague at work is now getting phone calls from Capquest at work, which is embarrassing for her. I would recommend you deal with it before they try this tactic on you. I appreciate you have various outgoings so may not be able to afford to pay what they suggest, but offer something with a promise of reviewing the amount later, they may go for it. If you have an available lump sum you may want to offer a full and final amount a % of the outstanding debt.

  • Just to clarify, when did you take out the debt and when did you last pay or acknowledge the debt in writing? Not doing both for 6 years means its statute barred.

    Never give Capquest your phone numbers and personally, I would never give them my card or bank details. Insist they deal with you in writing as they may say things on the phone they would never put in writing.

    Is there any doubt this is your debt?

    Presumably you intend to start paying what you can?
