    Just a quick email to say that ohreally is really really correct! You can either go in on Monday as if nothing has happened, or go to the CAB on Monday, with copies of all the various emails, and take their advice. Your employer does not, on the face of it, have a basis for dismissing you.
    Ex board guide. Signature now changed (if you know, you know).

    Seems both parties made a mess of things here.

    You should not have acted in the way you did, and your employers certainly are not in a position to say "you have been replaced" so hastily.

    The only way you can be dismissed summarily is if you have committed an act of gross misconduct, however, the employer, still has a procedure to follow. Sounds as if they just went in the huff.

    Is there an HR department you could talk to?

    You need to go into work on Monday to talk to someone and sort this out.

    If all is as you state in your first post then I would say you need to seek some professional advice, if you are a member of a Trades Union this should be your first port of call as the advice and support will be free and sound. If not then CAB, ACAS or even TGWU should all provide sound advice also.
    An employer cannot act in the way you describe even for gross misconduct, obviously there are I'm sure much finer details that will affect the outcome, but on the face of it you have been wronged and there is support out there for people in your situation.

    i cant understand why you would do this! dont mean to be nasty i really dont but sounds strange to me!!!

    its like them offering you a job monday, then them saying to you on tuesday no sorry its be given away, then them deciding that you can have it i know i would think shove your job!!!

    I'm intrigued as to why the T&G (unite) would provide advice?

    They often supply advice to non members it's one of the best recruiting tools just not trumpeted.

    I think it all depends on how you phrased that email. It sounds to me that the employer believes that you have resigned. Go and take a look at your sent messages. It it was in fact phrased as if you were leaving (and quite honestly it may well have been when you look at it again) then it may be that your resignation has been accepted. In fact, from the fact that you asked if you still had a job, that says to me that you know it was a resignation, or sounded like a resignation, in which case you are up the creek without a paddle.

    If that is not the case then the advice from other posters still applies. After 5 years employment you have a lot of rights.

    If you have a regional office close then I would say that would be your best shot, some smaller branches may snub you out of ignorance, but most within the Trades Union movement these days accept that the vast majority of the workforce are not affiliated and first contact and impression is long lasting, from their point of view it would be foolish to hold themselves aloof over membership dues. Maggie did serious damage to the unions but fortunately it wasn't terminal and memberships are beginning to grow again as people realise not all Trades Unionists are militant bung taking anarchists.

  • Something more is going on here. If i emailed my boss 2 say i wasn't coming in i'd be in major trouble the next day, but he wouldn't just tell me i'm being replaced. It sounds like u and ur boss have other issues. Is ur job contributing 2 ur stress? Perhaps ur better off elsewhere?
