Summons for non-payment of C Tax

Hey guys,

I received a scary court summons for non-payment of C Tax. It took me by surprise as I have been making monthly payments of £100 since April and am up-to-date. So I called the council up tofind out what’s going on. They said the installments should have been made by 1st of every month, starting in April. I had been making payments around the 25th of the month to coincide with my salary payments and had no idea that payments weresupposed to be made on a particular date. Apparently, it was in the firstletter they sent me, at the bottom of the page, but wasn’t mentioned on the 2reminders that followed. :mad:

Anyway, I cleared the balance for the restof the year and had to pay the court summons cost of £50. I managed to avoid theliability order of £30 because I paid it all up front.

My question is, yes I know they are acting withinthe law, etc, but it all seems very heavy-handed. It was a genuine oversight onmy part regarding the payment dates but I was making my monthly payments ingood faith. Is there any way I can recover the £50 summons cost ? If so, whatis the best way to go about this ? Is there any point appealing to their betternature ?

    Only if the council wish to do so, they are under no requirement to do so. You can but ask.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
