Hi my partner has decided to rent a flat, she just wants to start her life over – however we have a mortgage in joint names. I am trying to find out if she is allowed to just walk away, leaving me to pay the mortgage?

She is legally liable for the whole amount, and so are you. It's called jointly and severally, The lender doesn't care as long as it's paid. they will chase whoever they can if it's not paid. Remember it's not half and half, you are both liable for all of it.I am not a cat (But my friend is)0

Can you rent out a room?
Sell up and move on with your life or buy her out of her share0 -
Probably best trying to sort this out sooner rather than later.
Even get a Mortgage to put it solely in your own name or sell up. If she doesnt want to pay short of going to court you cant make her - but if your making full payments, when it does go up for sale she could claim half of any profit...I am a Mortgage AdviserYou should note that this site doesn't check my status as a mortgage adviser, so you need to take my word for it. She had said we had grown apart and we did discuss selling up...! - I thought she would have waited until we had sold the property. It came out of the blue her moving into a flat this quickly. I'm too old now to start a new mortgage - I was just getting settled0

I wasn't thinking of it being half and half, but she seems to think she can just walk away - it would be nice for her to realise the mortgage has to be paid, however I was hoping she would realise her side of the joint accountShe is legally liable for the whole amount, and so are you.
