Hiya,
My husband contacted CSA that his oldest son was not returning to full time education in September and asked them to adjust the payments as necessary.
Csa then contacted my husband stating that they would contact child support (benefit family tax credits?) to confirm to see if his ex-wife had informed them of the sons change of circumstances, he was then told that she hadn't. Therefore they won't amend my payments.
He said to csa that his son had left college and was in the process of joining the army but had also had a prt-time job over 15 hours a week, csa then said that he must contact child support (benefit) but my husband isn't so keen to do so as csa said she might be committing fraud by still claiming benefit for the son.
Anyone had this problem? Who do I phone?
Seems a bit of a strange way to do things!

Sorry, a bit confused...what are your payments in all this? Are you the mother of the child and if so, what's the ex got to do with it? And why is she claiming child benefit?Sanctimonious Veggie. GYO-er. Seed Saver. Get in.0 -
As long as they have been informed verbally and i would do it in writing as well, that there has been a change in circumstances, then they will be able to backdate it to the date you requested it...
And again, we come back to the qualifier being CB, when it is not a legal point that they have ever proved nor is it in any legislation as the qualifier...!!!
I would write to them recorded delivery, asking again that it looks at the request for reassessment due to changes, and that they may liek to remember that CB is NOT a qualifier, and that you would require the proof from them that it is in the legislation as a qualifier, and that if they insist on using this, you will take it up with you mp and make a formal complaint... Also suggest, that as they have access to the HMRC database, they could indeed check themselves to see the employment of this "child" and thus that he no longer qualifies for CB anyway...0 -
I'm presuming this child officially left school in the summer? If so he would normally be excluded from the assessment the first Monday in September. These exclusion dates are standard and do fall broadly in line with child benefit exclusion dates. How old is your step-son?0

im finding it difficult to help with this one , as we are in the same boat as yourself, we have been in touch with cb, mp etc, and seem to be in the same position now as then.

My husband is still paying for 2 children that haven't been to college this year at all! Because the CSA say maintenance has to be paid whilst pwc claims child ben.They refused a ch of circ from us earlier in the year ,they say their only concern is that pwc gets ch/ben.You will find though that if he only left college this year the mother can claim ch/ben until end of August /the first Monday in Sept. the time the educational year ends( UNLESS the qc does over 24 hours of paid work a week when the pwc must tell the ch/ben & it will stop from then)0

cally, for good it could or couldnt of done, did u get proof from college of non attendance, also, did you report it to child benefit0

yes in feb & march,also to ch/ben & asked for a ch of circ recently which they said no to !0

Have you reported it for benefit fraud,, have you been too your mp for help,0

yes,MP said the CSA have rules to follow & we have come back to ask they look into it further. It's not fair that she can break ch/ben rules to fit in with CSA rules & legislation !Reported to fraudline feb and then again later on.They said Data protection laws mean they(dwp) couldn't let us know if anything was being done about it !meanwhile she is being paid every month( if we stop paying they will take out a Dec of Earnings order without a second thought !)0

we have exactly the same problem cally, have reported it twice to dwp, and to no evail, due to the wording of the mother!!
It is gut wrenching, knowing that people can legally defraud the system and its ok!0
