JD Williams/Reliable Collections

Hi all - newbie poster (but seasoned reader) on the forum.

Via this site and National Debtline site we have started our own DMP and successfully negotiated with all our creditors for reduced payments and freezing of interest and charges.

All,that is,except JD Williams. We made the initial approach to them and have had several exchanges in what feels like a game of attrition. They refused our initial offer and we returned with a slightly improved offer (at the expense of a family member agreeing to a lower repayment to them). This was also refused but we stood our ground.

They have now agreed to accept the improved offer of £40 per month but it seems they have now passed us over to the joys (as I have been reading) of Reliable Collections from whom we received a letter this morning 'Notification of an agreed payment plan'. The last letter I received from JD Williams stated that,contrary to our request, they would not freeze interest and charges at this stage,rather review them after 6 months when the agreement is due for review.

We are not happy about this at all as this would mean that despite paying £240 over the next 6 months we would owe them at least £140 more than we do today.

I had already sent them the NDL proforma letter pointing out this when they refused suspension before but it seems this has held no truck with them.

We now plan to send a further NDL proforma to both JD Williams and Reliable Collections that states as they won't suspend interest we are not reducing the debt and therefore are not paying so sue us. We feel we have been reasonable and would hope that the court would agree with us.

Would anyone suggest a different course of action or are we on the right lines ? Also I guess we are to prepare for an onslaught of calls and letters from Reliable Collections....

    Would probably be a good idea to state that if they continue to refuse to freeze interest/charges, then you will also be making a complaint on the matter to the FOS. Quite a few people seem to get a result doing that.

  • Maybe that would be a precursor then - something along the lines of giving them a last chance to agree before I write to the FOS to complain, and if they still refuse then fire off the complaint and also the refusal to pay letter.....will give that some thought. Got 3 weeks before first payment due so will be tight timewise though judging by their previous slothness.
