Dealing with the OR - Help!

Hello Forum :)

I was declared bankrupt on 10.7.2013. Have recently been dealing with the OR and a combination of not being prepared and them not understanding my situation has left me confused and worried.

They calculated our household total expenditure wrong as the details on my bankruptcy forms where my expenditure not the household. I've managed to get a few of the extra items onto the expenditure, however they are refusing listen to anything else now and saying let the court decide. The main problem is that my partner is at university and they wont allow for books / course costs etc. They are concerned about the effect this will have on their course.

Also i don't understand how they take all disposable income? What happens incase of emergency costs? For example we've had an emergency household repair his week at a cost of £60. How are we meant to pay this with no room for manoeuvre on the monthly budget.

I've raised concerns with them but have been met with a sign the forms or lets go to court response.

What happens when we go to court?

Can anyone please point me in the right direction for advice?

    Thanks Fermi.

    I'm going off for tonight and I won't be back till Saturday. My advice to you is DO NOT SIGN and then lets have a look at what is reasonable, not what the Insolvency Service think is reasonable. You are quite right that you require some spare cash and reasonable allowances as per the Insolvency Act 1986.

    I will help you with the IPA.

    Oh you poor thing! I in on a DMP and some firms just don't seem to get it. I am also doing an OU degree and having to miss (valuable) tutorials etc because I cannot get there. Plus stressing about the financial problem has a huge impact on course concentration and marks. So I really can sympathise. Hopefully, DD will be able to help you out when back. Good luck.

    Looking back to the OR interview they actually told me what my expenditure was at times during the interview, they didn't ask me what it was.

    Advice for anyone who's interview is coming up is make sure you're prepared. I wasn't and its impacting me now.
