can i claim back loan charges?

hello all
im after some advice with a welcome finance loan I have, I took it out back in 2007 and have had a payment plan in action for just over 2 years to pay it back, however shortly after I took out the loan (2 months) my work dropped off was full time but got made part time and could not make the monthly payment.
I contacted wf and we could not agree on a monthly figure as they were asking for 80% of my wage. in this time no payments were paid ( I know stupid should have made token payment) this went on for about a year as I could not find other work. and even cab could not get them to talk as wf was not interested in talking to cab
the loan was for £4436 inc interest over 3 years.
im wondering if I can claim back default charges? (about £3000)
it was only when they sent it to a debt collector I got a payment plan as they were willing to listen. the interest is now frozen and now owe £6377 :eek:
is it possible to claim back and if yes how?

  • they were default charges and probably in the t&c`s and you by admission defaulted

    maybe so but if they were willing to communicate it would not have go on for so long and the charges would have been a lot less

    it is not my fault they were being unrealistic

    So the charges are about £80 per month?

    Charges added should be reasonable according to OFT guidelines.

    Are you sure it wasn't interest, as that's not charges. They can do that, as they do not have to freeze interest.
