CSA should have finished 23/06/2011

Hi There, I am new here so please be gentle.

I was under the impression that my son started college in Setember 2011 and was due to finish his course in June 2013, he will be 19 in September 2013.

I emailed the CSA Wednesday to see if my CSA payments would now cease and I recieved a telephone call Thursday to inform me that they have recieved my email and would ring the PWC to see if he is returning to College in the September or if College has now ceased.

Today I recieved a call from the CSA telling me that my payments should have ceased on the 23/06/2011 as my son did not attend College.

During this call I was informed that my case is now closed as of today and conformation of this will be posted out to me. I was also told that another CSA employee will assess my case and inform me of any monies to be returned to me.

My questions are:

1. Will I recieve all the payments made for the last two years (I have no arrears)?
2. Does the PWC pay the money back or does the CSA pay it back?

  • Yes, to both of those. If they're backdating a closure then any payments made after the effective date of the closure should be repaid to the NRP, and the PWC would be expected to repay the Secretary of State.

    It's worth being proactive on this to ask when you'll get your money back - an overpayment that high will need to be signed off by someone quite high up so give them another call on Monday or Tuesday to make sure that the repayment process can be chased along. Have you been paying by direct debit? If so then they'll have your bank details for any repayment.

    I have just checked my CSA stuff today and find that my Son was 19 two days ago. I've been paying since we split up when he was two and have not seen him.

    Have you got a email address (link) for the CSA to find what the status of the claim. I reckon he has not been in college since leaving school so I'll prob be in the same situation as you.

    I don't want to write to them as I hear it takes an age.

    Surely if the pwc has been claiming ch/ben (even fraudulently as son hasn't been to college ) the CSA would have taken the payments like they are doing for us quite legally.The CSA told us their only legal requirement was the fact that the pwc claimed this -they could take the CM & we wouldn't get any back. We have done all we can to inform them about the college scenario but they aren't interested!

    It's a lot quicker to just ring them up.

    Follow it up with an email enquiry if you want, but they'll have to ring you to verify that it was indeed you who sent the email.

    It sounds as though (in this scenario) the child benefit has ceased to be paid in 2011, which is why they've been able to back-date the closure.

    Unfortuneatly no, It would be up to the PWC to re-pay the money owed, as you didnt raise the change of circumstances yourself, there was no mistake on the CSA's part. The bit about the pwc repaying the sec of state was an old rule that was scapped a while back.
