Bailiff help

Hi. I went to buy a franchise business of someone who was closing it down as my daughter went and it was really good and I did not want it to close. This was last November and he was closing it December.

He stayed with me while I learned the ropes and he wanted 5k to buy it but I said I'll pay once I have checked it out. A month went by and it didn't feel right he done secret back hand parties and kept the money and it didn't make as much money as he said

I backed out of the deal which in a way was good as my finances took a big dip from another venture I was doing. I had given him a 1000 deposit and 500 pounds extra a few weeks later

He wasn't happy it seems as I received a county court letter trying to sue me. I responded and they sent another form which I sent but they said they didn't get it so they sent me another one that I sent back but they ignored it as they said didn't send it quick enough but I sent it the day after I got it. Judgement giants me was entered and he won. He is very under handed and I know now he was looking for a mug to get money out of. Me sadly

So I moved in may and I had bailiffs turn up today demanding money is there Nothing I can do. Asy life is so hectic I don't have time for all this. He lost the employment trial at court and was ordered to pay staff wages as he tried to pass it onto me but the court deemed that I did not own it as the company that owns the franchise said I did not sign the agreement with them

Also on the court form he lied he said it had been signed over to me and he didn't mention the money I gave him either

I am doing this on my phone so I hope it all makes sense thanks

    Was the county court letter trying to sue you in fact a county summons and judgement has now been entered against you and the claimant is now enforcing this by sending bailiffs?

    Yes he got judgement it's like the court ignored anything I said and now it's being enforced and if I have to pay him 5k it's a con as he doesn't deserve it and it just means we have a crap justice system

    There was no hearing my defence was filed but all I said was he never said he was suing me or gave me the chance to respond as is required. Then they said fill out allocation questionnaire which I did but then said they didn't receive it so I sent another one next I got was a judgement

    File a N244 form stating the papers were not correctly served.

    So he sued you in court, and the court gave judgement in his favour?

    Sounds like you lost then. :cool:
