Where do I go now?

Hello,

I have been receiving letters off Cabot over the past year or so, they have been chasing me for £605 which was an old Barclays overdraft I think from years ago, although I'm not 100% sure as it doesn't show up on my credit file. 8 weeks ago I sent Cabot a 'prove it' letter as I know for a fact I don't owe that company any money at all. They have written to me twice over the past 8 weeks saying that they are investigating this and that they have contacted Barclays and they are awaiting their reply.

My question is, where do I go from here as they have now exceeded the 8 week time frame?

Thank you.

Dean.

Nowhere. The ball is in their court. You are not paying anything. They are not harassing you or demanding payment.

If they come back with evidence that links you to the debt and it is your old overdraft and you agree with the balance, then come back here for more advice.

If it is that overdraft, when did you last use the account?

They have come back to me with my old bank statements, although this doesn't prove that I owe them the money I don't think...

There is no evidence on my credit file as I haven't held an account with Barclays for over 8 years, all I have is a default from Cabot saying that I owe them this money.

Where do I go from here? They have given me 21 days to respond.

    Thank you!

So it is your old overdraft, presumably now owned by (assigned to) Cabot.

And the answer to 'If it is that overdraft, when did you last use the account?' is 8 years.

Forget the credit file - that isn't going to help us.

Your response should be to send the letter in post #2

Unless there is something very unusual like you didn't breach the credit limit for years, this debt is statute barred and you can tell them that you will not be making payment because of this.
