Selling House - survey has found flying freehold

Hi there, am in the process of selling my house and the buyers surveyor has indicated that I have a flying freehold on the property. I didn't even know what this was! I looked at my survey and have the documents from the previous one and the surveyor on both has not mentioned it! My solicitor is going back to the buyers one to ask where he thinks it is....all I can see is the eves of my extension and guttering jut out in to my neighbours garden by about 6 inches. I called my mortgage company who tell me if they had known this they wouldn't have given me my mortgage and I'm terrified that my buyer won't get one because of this. I am seriously in debt (hence having to sell my house) and really don't know what to do. If this sale doesn't go through I can't keep going much longer (I already have a DMP with CCCS) has anyone got any advice? This has really got me down.

If you have flying freehold then physically there is not a lot you can do to change the situation.
However:- There are a few lenders who will consider FF so don't give up too soon.
- Did you pay for a Homebuyer's Report when you purchased the property? If so, you may be able to claim compensation if the surveyor missed the FF and you find yourself financially disadvantaged.
