No CSA payment... what can I do?

    Can you do some private work for three hours on a self-employed basis. Cleaning? Gardening? Even selling through a business account on ebay. You just have to be working three hours a week in the business - this can include admin and advertising, if it is an ebay business it includes photographing, listing, taking things to the post office. You don't even need to earn NMW for the three hours, you just need to be working in the business (this will change when tax credits go to Universal Credit, but all you need to be bothered with is what happens right now).

    I do not like relying on him for the CSA money... However, I already had the mortgage before we seperated and have only ended up in this situation due to the changes at work. My mortgage is significantly cheaper than renting would be,

    I am also involved in a very lengthy legal battle with him in order to protect myself and the children from him, which is costing nearly £1000 a month (it has even exceeded that at times!), therefore I have spent all my savings and 'emergency' options on that. This has been an entirely necessary expenditure. I am able to go onto legal aid at the end of July, which will give me massive breating space financially and, once I get back on my feet, I will not 'need' the CSA payments from my ex.

    I'm sorry to hear about your situation.

    "I am waiting for a claim to be passed for the mortgage allowance but the Jobcentre are taking ages to sort it despite me passing the 13 weeks (they lost the forms, computer accidently cancelled my claim etc!)".

    A couple of jobs here for your MP. Phone the MP's office up and tell the assistant your predicament. They just might be able to speed up the CSA and can certainly help with the Jobcentre botch up.

    Thank you Sensemaya. I desperately want to keep the house, basically because it is cheaper than renting but also because it is my girls' home and some kind of stability for their future.... although it is only a maisonette!

    The legal bills are so big because solicitors charge a fortune, and because my keeps contesting EVERYTHING that the courts decide. He does this because he knows it costs me money to get advise and representation from my solicitor (he actually says this). He is violent, aggressive and dangerous, and protecting my children is 100% my priority and will come before anything else, I will lose the house and everything in it if it comes to that, although I would obviously prefer to find a better way!

    Great idea to contact the local MP. I did this before when my ex reported me for tax-credit fraud- I wasn't frauding anything but they stopped my tax credits for 14 weeks whilst I was 'investigated'. Eventually my local MP sorted it within 48hrs. I will call them in the morning!

  • yes, this is what they do, my ex loon is pulling this crap at the moment, employer can take ages to send payment on then csa take ages getting it to you, meanwhile these !!!!less NRP's get away with it

    I'm not really sure what else the CSA could have done in this situation - sounds like a payment has been missed in July, so they're taking steps to get a DEO in place for August - the employer then legally has up until the 19th of September to send that money in to the CSA.

    OP, could be worth giving them a week or so and then phoning to ask if the DEO is in place yet. There are letters that legally have to be sent to an NRP following a missed payment, and timescales that have to be allowed for prior to setting a DEO.

    Ha ha, yes I have had this a couple of times! Apparently I am having wild cocaine fuelled parties at my house while the kids are there, and apparently my Dad is a !!!!!phile..... Luckily social services and Cafcass have seen the malicious lies for exactlywhat they are!

    I am hoping that my costs can be ordered back to him, considering that he has said in an email that he is only doing this to cost me money and that he has stopped paying CSA.

Yes when social services phoned me and I told them we had separated she replied that it's very common. Still upsetting at the time though.
