Actually, it is with good reason. An outside solicitor working on behalf of one member on something which affects other members may broker a solution for that member which the union (being its members) does not accept for the rest of its members. There are so many variants on sceanrios that 'no outside solicitor' keeps it simple. Where a solicitor is required the union will provide one.anamenottaken wrote: »This is appalling that unions would seek to so control their members.
As for 'the union controlling its members', no, it is a case of the union (being its members) coming together and agreeing how to handle issues for the benefit of all members. People are free to leave if the find the options elsewhere to be better. You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'0 -
It doesn't sound like fair and proper treatment to me, based on the information given.0

She needs proper legal advice, and quickly.
Don't send her to the CAB, since they generally don't have the kind of expertise that is needed: at best they would refer her to a solicitor they know, and this would take time. If she is in a union then that has to be her first port of call (and if not, note that now it is too late to join); otherwise she may have access to legal advice through her home insurance. There is also a government body called ACAS that might help.
Note that even if she falls under the new rules and has no protection against unfair dismissal (since she has worked for less than two years) she is still protected against unfair discrimination: a clever lawyer might be able to argue that a man in her position would not have been treated in this way and so obtain compensation for her.0 -
A union will wade in to such disputes even if she has nor served the minimum period for job protection.
They may not be able to legally prevent them sacking her, but they can bring a lot of pressure on the education department by working as a unit.Be happy...;)0 -
Ad said before, nobody get three years for a motoring offence unless they have killed someone. More to this than is being disclosed.0

What country in the UK are you in?
In England and Wales the maximum sentence for driving while disqualified is 6 months and 12 months Scotland. In both dangerous driving has a maximum sentence of two years. The only driving offenses that could lead to a three year sentence is causing death by dangerous driving or causing death by careless driving under the influence of drugs or alcohol, which can receive a sentence up to 14 years.
So either this is a very serious driving offense, or the offense is something completely different.
They are all detailed on the link below.

Bear in mind that the OP is only getting their info at second or third hand. As far as drink driving is concerned, a repeat offender gets a minimum three year driving ban, so maybe that has been confused with the length of the actual sentence.
(Not that any of this will be of any help to the OP or their niece.)0 -
couldn't he have been given several sentences at once?
IE driving with no insurance, drink driving, and dangerous driving all at once???
To be fair if he'd killed someone - it would have been all over the front page of local press, and I think the OP would know. Gossips love that kind of stuff.

I have a distant nephew who got 3 years for driving whilst banned under the influence.
It was his third crack of the whip and he was unable to stand on his own when stopped, he had previously done a 4 month stint having been out only a month.Be happy...;)0 -
