Thanks for reading my post, was hoping someone could help me out.

I received a Parking Eye PCN letter around 2 months ago, in relation to overstaying in the car park of a local retail park. I am the registered keeper, but I was not driving, I was at work at the stated time of day, there are three other people who are also insured to drive my car.

I decided to ignore the letter, and was sent a reminder, which I also ignored. I have now received a third letter with an increased amount on it.

I have now been reading that the best thing to do would have been to put an appeal in. Could anyone offer any advice as to what I should do please? Would be very grateful.

    You have two choices:

    1) Ignore them and wait to see if they send you a half-baked "Letter Before Action" or start a court claim. If they do either of those things, ask for more help.

    2) Write to them and tell them who the driver was. Not very nice on the face of it, but it does mean that they will send that person a Notice to Driver, which re-sets the clock and gives the driver an opportunity to appeal and get this thing killed off at POPLA, with our help (if receipts from the retail park are available ParkingEye might cancel it themselves, or then again they might not).

    Oh, and moan and whinge at the stores on the retail park, and if you can find out who owns/manages it, moan and whinge at them too.

    Thanks for the reply, I'll probably go for the 2nd option. I'm not sure whether or not there was anything bought, and if there was then it's unlikely that they kept the receipts.

    That's OK, the receipts aren't essential, it's just that sometimes ParkingEye cancels a charge when presented with receipts.

    If you go for (2), make sure the driver knows and understands, as he/she will need to do the appeal (or at least be willing to have his/her name to it) and although a win at POPLA is very likely if you follow the advice here, there's no guarantee. And in the unlikely event of a loss at POPLA followed by court papers, it'll then be the driver who has to fight it.

    Not trying to scare you, you just need to know exactly what it means if you dob in the driver.

    Ah understood thanks- I'll have a word with the person and make him aware. I have a feeling though that he might just go and pay the money.

    Then direct him here first. I don't care if people are stupid enough to throw their money away, but throwing it in the direction of a bunch of scammers is really not the best thing to do - it only encourages them, and there are far better causes who would love the cash.

    If that is the course you have decided upon you don't need any magic words, just drop them a line saying "I wasn't the driver, he was".

    Has to give the name and postal address of the driver for service of Notices.
