Should i pay this?

about three years ago i made the mistake off taking out two mobile contracts with 3G, about 8 months in both phones stopped working and after numerous conversations with their unhelpful staff they agreed to send a courier round to take both phones to be repaired, when they finally returned the phones they still didn't work and i kept telling them to cancel my contract as i had no use on a network that i cannot make calls using phones that cannot switch on.

After a while i smashed both phones to pieces and returned them telling i won't be paying another penny due to breach of contract (which was a stupid thing to do because i'd obviously done the same). I never heard from 3 again and this was two and a half years ago, untill recently where i have received demands from a collection agency, i am thinking of letting it go to court because 3 basically flogged me two dead horses.

Any advice would be appreciated, and i now have a 1 week deadline before fees are added to the balance.

    Do you have any proof of what you are stating? If they were under 1 year old, were they not covered by the general guarantee?

    I suppose the only proof you *could* have is that neither phone made nor recieved a call after the date you say they broke.

    I'd contact three again and state your case, say that your complaints at the time were ignored and you are very unhappy they did not cancel the contract as requested and are now chasing you for services you have not used.

    It was a daft thing to do, smashing up the phones. They are technically 3's property, working or not, until the last day of your contract, are you sure the charge isn't for this? You also left it too late thinking that they'd never get back to you. Sadly debt chases you and bites you on the bum when you least expect it.

    I'd try and argue the toss with 3, but at the end of the day they have a strong case and you may well have to cough up.

    Hi,
    Problem you have is when you take out a contract for a phone the minimum time is 12months.So they have the right legaly to persue you for outstanding monies due.I f you contest there actions by saying the phone was no good you would need evidence to back this up.However in my opinnion they will not take action to persue there debt.Why? it's simply to costly>i come accross this regulary in my industry.
