    Send then the prove it letter do that now.

    It stops them from progressing doing anything.

    You asked for advice several months ago, got it then ignored it. follow that advice, don't offer anything.

    Sorry but I didn't get advice and then ignore it! My last post from that period actually asked for clarification which I never got but i was grateful for the help I did get! Sorry but that seems a bit rude to me!

    But thanks for clarifying that for me anyway, thats what I shall do.

    Lowell are not very good at, lets say, acquiring the correct paperwork, when they take on these accounts, send them the prove it letter as advised above, see what comes back, remember they have to prove that you owe this debt, its not up to you to prove you don't, chances are they wont be able to supply it and may, I stress may, write it off, as happened to me.

  • Does the payment arrangement sound right at all? Some companies have a habit of adding defaults a long time after they should have done.
    6 years ago would be 2007.
    See what they come back with. First they have to prove that a debt exists and they are entitled to collect it. Then they have to prove that it isn't statute barred.

    We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    We understand a copy of our credit agreement should be supplied within 12 working days.

    We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

  • That's the CCA request letter that was mentioned earlier on in the thread.

    You might want to try the prove it letter first - whilst you don't necessarily dispute the debt, it's a good tactic to give you a bit of time to properly search through your bank statements and see when you last made a payment.

    Whatever you do, don't ring up Lowell's and ask them! Aside from the fact that it's not in their interest to tell you, they're (in)famous for 'inventing' payments to stop a debt from being SB.

    If they get back to you with proof of the debt, then send the CCA request (which will take more time). In the unlikely event that they come back with a valid agreement, hopefully you should have found out whether or not the debt is statute barred. If it is, then pick the right letter from here.
