Environmental Search / Indemnity Insurance

Hi all,

Thanks all for your advice of my last thread on the subject of environmental insurance back in May.

Progress (or lack thereof) since...

End of May - Initial environmental search was "referred".

1st June - Advanced environmental submitted to search providers, and was chased up over the course of the month

30th June - Search providers claim to have "lost" documents, which were handed in in person by solicitor.

5th July - Search was recommissioned with promise by provider of 2 day turnaround.

Today - Search provider comes back with the below:

> is unclear whether the Site was remediated adequately, as there is no
> indication that all conditions were fully discharged.

> investigated under the provisions of Part 2A of the Environmental Protection
> Act 1990, and whether the Site is suitable for use.

> If you can send this in then we can arrange for Argyll to review.

Arghhhhhhhhhhhhhhh!!!!!

I understand from our solicitor that, even if the report fails, we can purchase one-off indemnity insurance for about £300, which should cover us for all eventualities - does anyone please have experience of doing this...?

It's a lovely, semi-new estate (built in 2000) full of people, so it is surely a surmountable problem sooner or later

    Bump!

    LA came back saying they would have to investigate the history of the land reclamation further, so our solicitor has recommended we go down the environmental indemnity insurance route.

    Does anyone please have experience of having done this...? Has anyone had to claim on it ever...?
