Threat of removal contractors to seize goods

I went to University 12 years ago but had to leave at the start of the second year due to financial problems. Part of this meant I couldn't pay my accomadation costs. The University took me to court and I a county court judgement was setup of £1.00 per month. I've been paying this for years.

Today a letter was sent to my parents address (the address I used to live at, when the CCJ was awarded) - the letter says that they will be attending the premises with "removal contractors" on 17.7.2013 to "seize and remove" sufficient good to cover the outstanding amount (about £4,000).

I'm not sure what to do, so far I have written them an email to their email address on the letter - as this will be logged - and said: -

  • That I wasn't aware there had been a problem with any of the payments, if the credit management company are disputing payment of any of the monthly £1's - then I want them to tell me which ones they are disputing.
  • That the address they have written to is a mailing address and I don't live here.
They actually visited the adress about a month ago and my dad answered the door and told them I didn't live here (I assume it was them, as no one else is knocking on the door like this...).



I've sent the e-mail now, but don't know where I stand.



I have stayed in this house on and off in the past - but I don't live here. The £1 charge MAY have not got to them one or two months, when I had to withdraw cash to pay for rent, and I went overdrawn but I'm not too sure. I'll need to check.



My main questions, are, can I do anything to stop them coming to my parents house, and can I do anything to stop them chasing me in this threatening manner, and for me to revert back to the court order, even if they have not received one of the payments?

I do work full time, but have really stretched funds, and have no money in my bank - so can not afford legal advice.

    LOL paying back £1 a month whilst employed, and you wonder why they are on your case!!

    Were you really planning on repaying at that rate for the next 333 years?

    I'm not convinced you would have achieved that so I am in no way surprised they are coming to take goods.

    Even more baffling is that you think you failed to manage to contribute your £1 some months.

    As far as I am aware if the court set the repayments at £1 then they would have to go back to court to get this adjusted. Have you missed any court paperwork ?

    Have you served them written notice of your present address.
    If not why not ?
    First job is to get them off your parents backs.

    Contact the court and ask if you have somehow missed proceedings where they've had the CCJ altered. If the CCJ still says you should pay £1 per month, then that's what you pay.

    Note that they said 'removal contractors' and not 'bailiffs,' which probably means they're bringing plebs who have no power.

    no way! What is due is £1 per month.

    You may no longer owe £1 per month if you have missed payments
    If you receive a CCJ and don’t keep to the terms it sets out, the creditor can ask the Court to issue a Warrant of Execution. This gives a county court bailiff the power to visit your home or business to collect the money you owe – or to see whether you have goods to the value of the money you owe

    £1 a month is derisory, the judge must have been just taking the pi$$ out of the university. Surely you could have voluntarily upped it to something reasonable that wouldn't take over three centuries to pay back, especially after you got a job.
    I used to think that good grammar is important, but now I know that good wine is importanter.

    This is irrelevant. If the court hasn't amended the order, they have no right to any more than £1 per month.

    Morally, yes, the OP should pay more if he/she can, but legally they're not entitled to more money than that set out in the CCJ.
