HELP MKDP / welcome finanice

Hello everyone im new and im looking for some help here im stumped and so is credit expert any help would be great thanks

right what happened was i had a loan in january 2005 i kept all my payments up to date till about febuary 2006 when i was laid off from work i tried at the time to claim under my PPI to which i was told i was not covered for that problem so i left the account i started paying what i could again in july 2006 untill about september 2006, then i hold my hands up i never made another payment after that.

here is where my problem is MKDP have now started casing me for the money although it is nearly 7 years on, according to my credit record MKDP have had the account with them since 2005 and put it into default in 2010 which is not true. welcome went bust in 2008 as i checked my credit file in 2009 and it has satisfied on it in 2009 but now its in default and im being cased for a debt i dont believe i should pay now it all seems a bit funny to me

any help or advice would be great many thanks in advance

    If you have not made any payments since September 2006, and assuming that no CCJ has ever been obtained for this debt, then it looks likely that it could be statute barred - have a read up on the factsheets and links here - Statute barred debts and the Limitation Acts

    If they agree it is SB then after you have their acknowledgement I would seperately write to the debt collector to state that the default date registered on your file is incorrect and not in accordance with the ICO guidance on filing a default.
