Good morning to everyone,
First I want to thank the people who help in this forum and their creators, thanks to it I have managed to learn and understand many things about debts in the United Kingdom.
After a couple of weeks reading threats on this forum, now I have decided to post here some questions I have and I would be extremely grateful if someone could help me answering them.
I lived in the United Kingdom in the years 1999-2003. In 2003 I had to travel to Portugal for personal reasons and once there I could not to go back to the UK again. In the same year I used my debit card to spend the savings I had left in my Barclays Bank´s account and some months later a also used the credit card that I had from same bank (Barclays Visa Credit Card with £ 1.000 credit) consuming all the credit limit.
During months I did not made any payments to Barclays Card, but on the sixth or seventh month I began to send money to my Barclays account in the United Kingdom so Barclays Card could charge whatever they had: two payments 500 euros and one payment of 300 euros. What was my surprise when I called Barclays to ask for the outstanding amount to pay and I was told that I was still owing more than £ 1,200 and was there when frustrated and desperate and from that moment I decided not to make any further payments.
Now it has been over 8 years since I made my last deposit to my UK Barclays Account and now I begin to wonder what will be the status of that debt as this year I will be working with a Portuguese company in the UK.
I have written an email to a credit agency of the United Kingdom requesting a credit report from Portugal and the answer was to provide them the following documentation:
- Two documents proving my address in Portugal
- 1 document that can prove my last address in the UK
I have been told that once I send the documentation and fill out the form they sent me, they will proceed to issue my Credit Report. But I cannot remember what was my last address in the United Kingdom in that time (year 2003) nor I have any documents to prove it.
These are my questions:
1. Are my debts with Barclays Card statute barred?
2. In the case I start working again in the UK, would I be able to open a bank account to receive my wages? At Barclays? Perhaps better in another bank?
3. Will the Credit Agency send me the credit report in case I won´t send them a proof of my last address in the UK? How important is this document?
4. In case my debts are statute barred, what information about me can the credit agency have? Can they take advantage of my situation or affect me in some way?
5. Would anyone advice me not to request the credit report and show up at any bank and try to open a bank account?

I would be extremely grateful if someone could help me clarify these questions.
I made a big mistake at the time in a country that always welcomed me well and I hope life can give me a second chance to make things better.
Please accept my apology for my English.

Thank you very much.

Sounds like you are going to struggle to get a credit report anyway. You could try opening a basic bank account with a bank other than barclays, you need to specifically tell the bank you don't want any credit facilities just a basic account. Providing you can prove your identity, and your address then you should be able to open an account.
1. Are my debts with Barclays Card statute barred? quite possibly they would be, if they did not take you to court an obtain a CCJ against you.
2. In the case I start working again in the UK, would I be able to open a bank account to receive my wages? At Barclays? Perhaps better in another bank? you should be able to get a basic bank account from somewhere
3. Will the Credit Agency send me the credit report in case I won´t send them a proof of my last address in the UK? How important is this document? if you cannot provide them with your last uk address then they probably cannot match you up to your credit profile. Unlikely that they will send you a credit report.
4. In case my debts are statute barred, what information about me can the credit agency have? Can they take advantage of my situation or affect me in some way? After this amount of time it is possible that nothing appears on your credit file in relation to the debt. But it will depend on when they issued a default against you on your credit file for these 2 debts (that stays on for 6years from the date they record as the default date). If they have obtained CCJs against you these stay on for 6 years from the date of the CCJ.
So if they took you to court in 2006 it would no longer appear on your file (but would not be statute barred). But if they took you to court in 2008 then the CCJ would still appear on your report.

Hello Tixy,
I've been surprised by the precision of your answers and I really appreciate that you have answered my questions so clearly. Thank you for having spent your time here and for your help!!
Now I have things more clear and I will try to face the reality when I get to your country, in october of this year. What worried me too much was the idea of oppening the bank account and be rejected, but your info has given me a new hope that I will get a basic account without any problem.
I have another question, if you dont mind: how possible is that Barclays have taken me to Court and obtained a CCJ against me? In case they did it, at what time from my last payment (en of 2004) do you think the could have done this?
Thank you so much Tixy!!0 -
If you want to know about CCJs, you can search trust online at your last address. Not sure if they would show up post 6 years from granting.
They can get a CCJ for 6 years from last payment or since ou acknowledge in writing.
Much easier to get after this date if they make up a payment and its not defended.:beer:0 -
Thank you very much for your answer happy_bunny!!0

Good afternoon everyone,
I need to open this thread again and ask one question, I would be very grateful if someone can answer it:
When I go to bank to open a basic account, in case they ask me wheter I had debts in the past, what should I answer? Should I say NO just because I think these debts are statue barred?
In case the bank does not want to open a basic account for me, what should I do?
Thank you very much in advance.0 -

I wouldn't admit you had debts; but it's unlikely they will ask you if you are opening a basic account: even undischarged bankrupts can open a basic account, so you shouldn't have a problem.0

Thank you "Deleted User", thank you very much!! I really appreciate very much your help. I will take your advice and ask for a basic account, just in case they ask me if I had any debts in the past, I will say NO.
Thank you to all the people that help in MSE forums.
