No work done, can't get refund!

Hope someone can advise...

We had a quote for some flooring (vinyl tiles) from a well-known company. After some chasing we got a date booked for the work, but when the workman came he said the subfloor was in too bad a condition to lay the tiles. Someone from this company had been round to measure up so it shouldn't have been a surprise.

We were told we could have a refund or get the subfloor sorted and rebook. We chose a refund. When we tried to request it we were told the manager has to process it, so we spoke to him. He's told us they will only refund 80%, and is sending someone else to come and look at the floor to give another quote.

My question is if they now produce a higher quote, bearing in mind we've already paid for the first one, can they still refuse to refund 100% of what we've paid?

    Is the new quote to include bringing the subfloor up to standard?

    If so, surely you expect the new quote to be more?

    If it doesn't include upgrading the subfloor, why have you allowed them to quote again?

    Yes, I presume it will include bringing the subfloor up to standard, but then so did the first one. We didn't want another quote but they won't give us a refund so I don't know what choice we have. I would like some advice on what our rights are.

    You're entitled to a full refund. You paid for a service, they have broken the contract by not providing that service.

    Be assertive, tell them you don't want another quote, and they either give you a full refund or you will take them to the small claims court.

    Someone came round to do the second 'quote' today and said they can't do it without a lot of work, can't do it with the floor we've chosen or with the board the company chose for levelling, so we're expecting a refund now. Not sure how they can weasel out of it now!

    Just be persistent and make sure they refund 100%.

    If they refuse, just send a Letter Before Action!
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')
