unpaid wages

I'm writing this about someone I know, so can only put what the've told me, hope it will be enough. They had worked for someone for a while, and they didn't get paid, for I think 7 weeks, but then the company went bankrupt. I think it was the liquidators would'nt take over the company, because there wasn't any money. Is there anything they can do, do get what they are owed for wages? I think its really unfair that they might get away with it :mad:

    But please note the employer must be insolvent - ie in liquidation or administration (company) or bankrupt (partnership/sole trader).

    If the employer has simply ceased trading, then your friend can take the employer to an employment tribunal for unlawful deduction from wages/breach of contract, but if there are no assets that might not help much.

    At the moment there is no cost for making a tribunal claim but from 29th July it will cost £160 to lodge a claim for unlawful deductions and another £230 to proceed to hearing, unless you qualify for an exemption from fees.
