Not BR yet! but have Q re. Car Repo

Hi Folks, this is my first post on here having been a forum sifter for over a year now!!
I am as with most neck deep in debt and have been thinking about BR for a long time now, at one point I even went to the solicitor and forms to be told a week or so later they had been declined as none of my creditors had actually taken any legal action on me!!??
So confused and frustrated I left it at that, almost a year ago!! However since then things have become even worse and it now looks like I will lose my car !
I was making the payments on my car but due to seperation I stopped paying for a few months, then they finance company agreed to re-write the file to lower payments but the day I was due to go and sign all over again I realised I could not even manage the new lower payments :mad: However I feel letting the car go is probably for the best as it is at the point of needing lots of work (which I can't afford).
One thought I did have was that would this default and probable repo by the firm enable me this time to go BR????
Also one worry! The finance company said they would take the car back and then within a month they would arrest my wages/bank account!! :eek:
Can they do this or are they just trying scare tactics??

Hello and well done for taking the plunge and posting!
That solictor was full of poop. You can easily petition for your own BR and it does not matter if no action has been taken by your creditors.
The car company cannot touch your bank account.
If you are going BR, just include the car in the proceedings and the amount outstanding will be written off.
You need to decide if you are actually going to go BR first. Contact one of the free, independent places that can help you make the decision.

If you decide to go BR, stop paying everything, car as well, if you are paying anything. Just keep up with the essentials - utilities and rent/mortgage. You will need that extra money to save for the money to file for BR.
We didn't make a car payment for nearly 6 months (we were in dispute) and they never touched our account or threatened to. They simply are not allowed.

That is very helpful stuff though, did have appointment with CAB today but in the end could not make it!!
I did get the impression when dealing with the solicitor that she had no clue what she was doing!! Think I will contact the others and get more info and get the ball rolling asap!
Just so sick of feeling like this and feel really jeolous reading the posts from those who have done it

I knew it! Yes, we had a car on HP with them too. Caused us no end of hassle but thankfully it's over now and the car has gone back.
