Well, at last, the cat is out of the bag and Aldi has admitted that the ParkingEye PCN is a 'fine' and thus an unenforceable PENALTY. I expect PE will be rattling their cage very shortly!
Aldi UK Hi everyone, and thanks for your comments.

Blue Badge Holders should register their blue badge with the Store Manager. This will allow them to shop in the store for a longer period of time. Please note that the terms and conditions of using the car park still apply, i.e. that it is for use whilst shopping in store only.

In addition to this, the Parking Eye appeals process is clearly outlined on the reverse of the Parking Eye charges issued.

Our team are happy to look into any case where people feel they've received a fine unfairly - you can send your details through to customer-services@aldi.co.uk and someone will get back to you. Thanks.

It's from the Aldi response (today 10.55am) to the Sarah Smith post of yesterday (25/6).

Digging deeper Aldi.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I gotta screen dump of it. Anyone who needs it let me know, as not only does it admit to the penal nature of the "fines", it also admits to Aldi's flagrant breach of the Equality Act 2010.

Has someone also got a screen dump of the FB post in which Aldi state that they receive no revenue from PE's PCN's?

No revenue = no loss or at least if there is they aren't being refunded it. Which kind of makes the money recovered from PE's ticket recipients not what it is being described as.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
  • I've posted all of the Aldi screen caps across on PepiPoo on the Aldi thread in the Flamepit, including the revenue and fine ones plus a couple more, help yourself :)

It might get removed. Some earlier ones were. Pepipoo need to make sure they cannot be the target of vexatious legal suits.

How does telling somone in Aldi about a blue badge (which isn't required) tie in with ANPR?

Fact is it doesn't as no one is sat by the ANPR database entering the data of those who have registered with Aldi. Stay over time with ANPR and you will get a ticket - guaranteed.

Parking eye do not hold Vehicle Certification Agency certificates for the cameras they use, this means they should be inadmissible at the higher court as evidence.
So at the appeal court, you should be able to have the only evidence they hold ruled out, court rulings forbid local councils using none Vehicle Certification Agency approved devices as evidence and therefore it would not be difficult to extend that to a private company claiming to act under the protection of freedoms bill .
Just needs somebody to raise it at appeal court and out goes parking eyes only evidence they have against you .
    Be happy...;)

Wonder if its worth asking the BPA to comment on Aldi's admission that their agent 'Fines' people?
