Aktiv Kapital and Terminal Illness

hi all, first timer so be gentle, lol
i'm 39 and 3 yrs ago i was diagnosed with a terminal illness (statistically i should be long gone, so i'm quite chuffed to be typing this!),and im getting stressed over my financial state. i'll to give the basics to you first, and embellish as and when i need to. typing is slow and uncomfortable.
ive never been good with money and have the debts to prove it. i have a CCJ for 10 pounds/pm from yorkshire bank for a debt of approx 13,000. the court were very helpful.
i have an outstanding debt of about 2000 with RBS , and another of approx 3700 with AA finance. both RBS and AA are aware of my circumstances and RBS have since passed my account to a couple of firms but they've just sent the occsional threatening letter. now aktiv kapital have bought my AA debt and in a week ive had 3 letters demanding payment!
i have no savings at all, no property/assets, nothing! i live with my elderly parents, (my father is also disabled) who care for me, in housing authority property.
my only income is my DLA of 109 p/w
i guess what im askin is, should i write (i cant speak) to aktiv kapital and tell them to just take me to court, as there is no way i can afford to repay this amount!
a friend told me about this site and that i'd get good advice. i just want to end the worry and enjoy my remaining time. please ask ANY questions, i'll answer what i can.

Firstly, I think you are incredibly brave, and your post is extremely moving.
Secondly, try not to worry about the threats made be debt collection agencies - they are just that, empty threats. They know you can't pay it, you know you can't pay it, and a court would also see that you can't pay it. I'm not an expert in this area, but I think people often do write to the debt collection agency, offering a token monthly payment and including a detailed statement of affairs (income and expenditure) showing them that it is all you can afford. If they still insist on putting the pressure on, let them go to court if they must - a judge will only make you pay what you can afford anyway.

Snaggles beat me to it - just what I was going to say. Don't let them bully you into paying something you can't afford.
Well done on posting - its very brave of you to do so.
Write to the DCA, explain your circumstances and offer a token payment of £1 per month (if you can afford it) - they are obligated to accept it. It would cost them more in the long run to take you to court. These people make me so mad :mad: :mad:

Sorry to hear of you problem
You have 2 ways to play this mate,One you can right to all byour creditors explaining your situation and asking them to write of your debt to them enclosing a letter from your consultant/doctor then wait for replys.Or do nothing at all.Either way mate do not make a worry of it.

Hi sorry to hear about your illness..please don't worry about these companies..they are all bullies...I think the letter and a token payment of a £1 explaining your illness may help...
Also have you looked into your benefits as with a terminal illness you are not getting enough money...£109 p/w is nowhere near enough..there is a benfit section on here and somebody may put in a link for "entitled to" as I don't know how to do links..0 -
Hi there
You mention that you have no assets and just your benefit each week. My suggestion is that borrow £540 of someone (I think this is the fee) and go bankrupt. The money will be written off and you don't have to concentrate on anything other enjoying your time.

Hi and well done for posting. You are very brave and certainly do not need to have to deal with this right now. I would agree with the others either offer to pay a nominal £1.00 or ignore them.
My best friend sadly has terminal cancer and she also receives DLA but at a higher rate - have you checked you are claiming all the benefits you are entitled to. I cannot remember what site I visited when we sorted out her benefits, I will get back to you with it.
I truly mean, being so close to my friend and understanding what she is going through, I am so angry you are having to deal with this.

Have you got a friend or family member who you could appoint with Power of Attorney? I don't know much legal stuff, but if you could appoint someone else to write to your creditors for you then it would take a lot of the stress off you. I'm also pretty sure that if you're only in receipt of benefits then legally they can't take any of this money as it's the minimum that the government has decided you need to live on.
I hope this situation gets sorted quickly so that you can enjoy youself without this added stress

firstly thanks for all your replies and messages of support, its really appreciated!
secondly, im not brave, lol, i have a great family, wonderful partner and 2 lovely little girls to support me and keep me going! the brave ones are those who suffer alone, those without family and a reason to fight! ive had a great life and done so much! id be a liar if i said i wasnt afraid or bitter, but there ARE people worse off!
back to some points raised.
i am on the highest rate DLA for both components. this is the only benefit im entitled to apparently. i took voluntary redundancy from a job of 18yrs and, not having any knowledge of the benefit system, lived off my redundancy money for a year without signing on or claiming anything. because of this my N.I. contributions are apparently insufficient for any other beneft claim! all because i chose (foolishly!) to support myselffor 1 year !!!!!!! this has been checked by both the benefit people and social services!
