Is My Overtime Being Paid Correctly?

Hi,
Not sure if I'm posting this in the right place but couldn't find anywhere I thought was more applicable.
Anyhow, I'm not 100% sure that my overtime is being paid correctly. My salary is £15,039 per annum. I work a great deal of overtime and if I'm right the difference could make a little difference to my pay slip. If I'm wrong, well, I'm wrong.
So ...
My contract under HOURS OF WORK state -
'You are contracted to work 37 hours per week whereby your rota hours per week will be 40 as this incorporates 3 hours unpaid break over a working week. Your hours of work will vary according to the requirements of your place of work and your working hours cover 52 weeks of the year.'
Under OVERTIME it states -
'This position does attract overtime payments and must be approved in advance by management. Overtime is paid at your own hourly rate if you are performing overtime in your own role or that of a role in the same banding or higher. Alternatively, if you perform a different role, on an overtime basis, in a band lower than your current role then you will be paid on the highest NJC scale in that salary band which is applicable to that job.'
So, the over time I have been doing is in my own role in my own unit, basically just extra hours at work.
When I'm paid overtime I am paid at a rate of 7.82 per hour. This works out like;
£15,039 / 12 = £1,253.25 (Monthly)
£1,253.25 / 4 = £313.31 (Weekly)
£313.31 / 40 = £7.83 (Hourly)
I feel it should be worked out as such;
£313.31 / 37 = £8.46
As my contract is actually 37 hours and the extra 3 hours are unpaid break (which we don't actually receive but that's another story).
Basically, I'm just wondering which rate my overtime should be getting paid at, £7.83 or £8.46? I know it's only a difference of 63p but I often work 30/40 hours extra a week so would a nice little difference at the end of the month.
Hope someone can give me some advice and sorry about the essay!

I make it £7.82
I divided your annual salary by 52 to get the weekly figure and then by 37 to get the hourly rate.:j Trytryagain FLYLADY - SAYE £700 each month Premium Bonds £713 Mortgage Was £100,000@20/6/08 now zilch 21/4/15:beer: WTL - 52 (I'll do it 4 MUM)0 -
That is not how they work it out.
In a month there are 4.33 weeks not 4 weeks.Best Wins - New York Trip, going Nov 2014: £350 House of Frazer Vouchers: £70 Handbag: Nitro Circus Live Tickets0 -
Brilliant. I tried to talk to a lady from HR to get an understand of how they work it out and that's what she told me. Typical.
Thanks very much for the replies. Great help!0 -
Well I wouldn't point that out to her, if she worked it out the same way but on 4.33 weeks you would be even worse off...0
