i have used this site for reference and information a lot to help me get my debts under control, i am looking into a DRO and have the assistance of the charity shelter but my main problem now are 6 outstanding parking tickets i received whilst unwell, Unfortunately they had got into the hands of the bailiffs before i was again mentally well enough to deal with them. these bailiffs have tried a number of tricks to get into my property and last night one came to my doorstep saying i had been placed on a police database to impound my £400 old Peaugeut 106. He handed me a piece of paper that said i now owe £2,112.32 and i had 24 hours to pay. It also said they were going to call between 6am and 9pm on a day of their convenience. It also said this was due to my failure to make an offer, I have been in contact with them and explained i am classed as a vulnerable person and have a man from the charity group shelter helping with my debts and a possible DRO. I also included a means statement that he had prepared.
My question is does such a Police database exist? and can bailiffs use it and the Police to impound the car or is this simply another terror tactic being used by the bailiff? I have been worried sick since it happened and would appreciate an answer.

my first step would be to move the car to a friens or relatives where they cant find it0

The bailiff is talking b****s and knows it - also knows that a knackered old Peugeot 106 is going to cost more to remove than it would fetch at auction.
It is however just the sort of vehicle you want if you are going for a DRO
And if you've told the bailiff that, then he knows he doesn't have long left to threaten and harass you.
I agree you should put the car out of reach for the time being
I thought this thread was going to be about the bailiff threatening to call the police to attend - usually bad news as the police do not seem to understand bailiff law.0 -
i would like to thank you both for taking the time to reply. You have basically affirmed what i thought, I have moved the car and i did think to myself that if they wanted the car then they would have just taken it there and then. As you say it is not worth their while.
i purchased it to save money. And ensure that it does not break the DRO ruling of owning a vehicle worth more than £1000. But it has caused me a lot of anxiety for the last 30 hours.
It is clear to me now that many people incur their debts while struggling to cope with some other life trauma and it's wicked that these people pray on people when they are weak and at there most vulnerable, they can use such unscrupulous means to recoup a debt that started at £25 for parking in a space for more than 30 minutes, Madness!!
The good thing is that it has prompted me to take action and through this site i have learnt so much in 24 hours that i can now see a ray of light at the end of the tunnel. Once again thanks for the reply.0 -
So sorry I'm not sure how to use this site ~ I don't know what to do.
I have had a visit from an angry bailiff at 8.15 this morning. He was looking for my ex.
I told him we have split, he said he will be back later today with the police and a lock smith. I must prove ( with receipts), or bank statements what I own in the house. Most of my stuff is old or from eBay.
I phoned him back told him I can't get hold of my ex, but could I set up a payment plan as I'm sick with worry. He said pay in full (£880), by 5 pm today or he'll be back to seize my goods.
I phoned head office ( marstons), they won't discuss with me, as I'm not my ex.
I'm on my own with 3 kids, and going out of my mind with worry 😰😰😰0 -

OK, first of all stop panicing. Hard I know but these lowlifes want you to panic to disguise the fact that they have little power or authority.
Did the bailiff come into your property and did you sign anything when he visited? These are very important questions.
What is the debt that the bailiff is chasing? Is it entirely your exes?0 -
Do not set up a payment plan. He may be back but unless he has actually been in your house before, and has a walking possession order, he has no right of entry. Lock your doors and windows and do not let him in. How long have you been split form your ex? Do you know whether the bailliff visited them at your house?

I didn't let him in. He had a recording machine that he said was recording the conversation. I didn't sign anything.
It's a difficult relationship with my ex atm, our son recently had heart surgery and it has put enormous strain on our relationship ( and finances, as I didn't cope well). Me and my ex are trying to work through things. He works nights, so I have been unable to contact him.
This bailiff has never been into my house.
I have no idea what the debt is for as they ( marstons) won't discuss it with me.
The red letter that he handed me says hmcts south east and central London.
I have actually been physically sick I'm so frightened.

would not matter if he had been in . its not the debtors property and he doe not live there. if you know were he does live tell them. but dont let them in its not your debt so they can bog off.0

Sorry, I just wondered if they could take a car from outside my house? My car is leased as I'm registered disabled, however my sons car is in my name. Could they take it? The bailiff had a form with the cars reg no written on it? My surname is different from my exes. And my name is not on this red letter. The debt is not mine.0
