According to the DWP (at least in the meeting I was in about 2 weeks ago about Social Welfare provision and Hardship payments) - JSA is only for the person (or couple) claiming.
Money for children shouldn't come out of JSA - that's what Tax Credits are for... :cool:
Of course - in the real world that's not how things work...

If the family income wasn't high enough they would be getting additional benefits for the children - only an NRP can't get benefits for the children even if they have them 3 days a week and if fact have to pay maintenance to the PWC (even for shared care - under CSA1 & CSA2 anyway)
If on beenfits and have the child at least one night they don't have to pay the £5, but imagine this scenario
PWC is working full time, NRP is on JSA getting £71 a week, has the children every day while PWC works (ie 8 - 10 hours a day), but not at all overnight as live in a bedsit, so has to pay the £5 maintenance - could you afford to live and feed children on £71 a week - probably not, but that is the reality of the situation some NRP's faceWeight loss challenge, lose 15lb in 6 weeks before Christmas.0 -
I'm not getting into the pros and cons of this argument but I reckon they left CS1 going because eventually the child(ren) will grow up and the case will be closed. It has been successful since CS2 came in around 10-11years ago.We are talking a couple of quid difference. Get over it.
Paying a fiver per week for your offspring is a bargain.....0 -

I personally don't think the system (both human and machine) could've transferred everyone over in a realistic timescale...
And then there was the five year phasing period from CSA1 to CSA2 if you did get transferred...
They said it was to give the PWC time to adjust to the changes in maintenance. At the time the PWC in my case was in receipt of benefits and only getting £10 over the normal benefit payment so I was effectively giving the Govt five years to get used to the changes...

The CSA should have introduced CSA3 for everyone, at the same time that they introduced benefit disregard in April 2010, this would of most likely encouraged both parties to go for a private agreement to avoid the charges, also saving the tax payer alot of money.
As for CSA1 which i am stuck on, (which means that i pay £130 amonth more that what i would on CSA3) the CSA have no plans to change things for us, I did get a reply from the CSA about moving schemes and i got a letter saying that i was a looser and my ex was a winner on CSA1 so there was no plans to change,
one more thing it was Fathers day last year that Prime minster Cameron called people like me who pay maintenance, but don't see their children as runaway Dad's, dead beat Dad's!! who don't face up to their responsibilities, I look forward to what he is going to call us this year!!0 -

SighThere could be any number of reasons why maintenance is paid but there is no contact with the children...
I thought the whole idea of paying maintenance via the CSA was to 'help' NRPs face up to their responsibilities..??

Yes I did try the courts but i could simply not afford it, I only got £350 legal aid and had to pay the rest myself which i was told could cost me between £5000-£6000 and that i might not get access, while my ex was on full legal aid, so she could drag it out and it didn't cost her a penny, I could simply just not afford it with my CSA payments and living costs, plus i had my car stolen, my property damaged and my G/F was attacked by someone with a hammer. The police said that they could not be connected!!!
I did ask if the CSA could drop my payments so i could afford to goto court, but was told that the welfare and access of my kids was of no concern of there's!!
And yes I was beat up quite abit when i was with my Ex, but that never happens in the world of the CSA0 -
I recently went through the court process of a contact order and my friend filed papers this week. It only cost £200 and we didnt need a solicitor. Can you not do that route? Am happy to PM you the process, it was very easy.0

The 2012 Scheme wasn't ready in April 2010, and still isn't fully operational yet, so they couldn't transition everyone across.0
