How to ensure my employer gives me the correct tax code in the FIRST month

Hi again,

Is there anything I can do to ensure my employer gives me the CORRECT tax code by my first pay day? I don't yet have a p45 as I left my last job yesterday, so I'll be filling out a P46, then I'm guessing I'll be put on Emergancy, what measures can I take to make sure HMRC give them the correct code BY pay day.

The reason I ask is that I am still a student, working in my summer break, so I technically shouldn't be paying any tax, only NI, and with my pay now being monthly (always before been weekly) I'd have quite a wait to receive my tax back.

    There isn't a guarantee. Make sure p46 gets sent on time, and chase your p45.

    Unfortunately it's not your employers fault, they automatically put you on week 1 month 1 (emergency tax) and the inland revenue send out the tax codes. Your employer can't amend without the form.

    If you are only working in the holidays then you can fill in a P38(S) to get exemption from paying tax.

    The Tax office give you the code not the employer.

    As from April this year that form is no longer applicable.

    Cheers for all the help guys! Filling out my P46 tomorrow to the best of my ability, I'll then make sure it's sent off tomorrow (even if I have to send it myself!), that gives just under 3 weeks for HMRC to reply with my correct code, surely they can get that right! We'll see though, thanks everyone!

    Your employer should be submitting P46/45 online now.

    Since the online submissions started I haven't had a W1 code for a new employee without a P45. You'll probably get put on 944L when the P46 is submitted.

    Fill in the P46 and give it to the new employer asap. Then phone your tax office and explain who new employer are and give all your details they can then send a new coding notice to the employer. I got a new coding notice today for an employee, it took around 8 days from when she called the tax office.

    The P46 isn't submitted anymore, all new starts get notified to HMRC via the real time information submission on or just before the employees first payday.

    I think you may have misunderstand what emergency tax is. The emergency tax code this year is 944L, exactly the same as the normal tax code it's just operated on a special basis that doesn't consider what has happened earlier in the tax year.

    So for wages paid monthly you can earn £787 before any tax would be deducted if the emergency tax code was used.

    If you complete the relevant form (don't know if a P46 still exists) and hand it your new employer then your new employer can use the emergency tax code of 944L without any information being provided by HMRC.

    Sorry to resurrect; although the thread isn't that old. I'm a student hoping to find work over the summer too; just wondering (assuming I find some) if I'll be taxed each month and then have to claim back from HMRC, or if the fact that I've earned nothing so far this year will be accounted for in the tax code that'll be issued?
