Hi iv been off work since the 1st october 2012 due to cancer and chemotherapy. Iv had all my 28 weeks of sick pay. I have just found out that my job role is being advertised. This has never been mentioned to me and I have always told them I want to go back to work full time and in the same role I had when I return to work. I am not really bothered about my rights but would like to know if they should have discussed this with me first.
Thanks

Does the company you work for have an attendance management policy. If so, they should be following their own policy regarding that. I'm pretty sure they should have discussed the recruitment of your own job with you first unless they are trying to fill it on a temporary basis as they need someone to do the job whilst you can't? What is your last correspondence with them?0
