In their letters they state their telephone operatives are "specialists"... If they didn't know what they are talking about that would be awful practice as their interests & their customers interests have been severely compromised in this instance.
I think i will write another letter to the head of collections outlining the series of events & reminding them i was actively attempting to make the payment as agreed before the default date & may still be in a position to make this payment.
I will ask them to look at the case again, taking into account the circumstances & request them to confirm everything in writing once more, whilst agreeing to remove any default as a matter of courtesy in this instance, following which my dad will make the payment of £3000 as agreed originally.
The point is my dad will only make the payment on those terms & my hands are tied. Hopefully they will see reason & common sense will prevail :-/
They'll get less than £3k from a commercial sale so it makes sense for them to accept your offer. You are absolutely correct to require this in writing. 'Mistakes' happen and people get pursued for things they thought had been cleared.
Personally, I don't think they'll remove the default unless you pay the full amount.
