Hi all
Any advice on this would be appriated , i have obviously got debt problems ,which was mensioned on my last post, and dealing with problem and Payplan are on my case.
I have 17 credit cards debts, such as Barclaycards,Debenhams,Mbna,Allied &Leciester,Capitalone,Mark & Spencers,Goldfish,Hsbc creditcard,Skycard with debt totaling of £46311.58,i started with Payplan in july 2006,and so far i paid in £1200.Now total Debt to £45111.58.
Most of the craditors seemed to have accepted our offers, which varies from 6months to 12month period. But the only one creditor which is giving us pain in the butt is the Mbna, they seem to call us every other day requesting more money from us ,althouh we keeping on telling them that Payplan are dealing with our debt problems .
Now we know their number on out telephone ,we tend to ignore their calls, they also left a message today to call them asap,i don't think i will call them ,since i know what they want.
Also today i had received a letter from Mbna saying ...........
Numerous attempts have been made to contact you,at home or your place of business to agree a mutual satisfactory repayment plan.
To date this issue remains unsolved & and we are considering intructing our external collector agent Legal & Trade ,who will personally call at your home address.
You are hereby notified that we may authorise our collection agent Legal & Trade to visit you in order to discuss repayment of this account.
Our collection agent will visit you at home ,or if you prefer they can visit you at your work place .This will only be done with prior agreement.
If all other communications avenues have failed our agent will contact you the week commencing 28 May 2007,if this is not convenient for you then please call me on 01244 672355 requesting extension 14424.
can anyone tell me what this is about, and why is it they can't understand simple English, are they thick,or plain ignorent B

MBNA are like dogs with bones - they are probably just trying it on - putting the frighteners on you to pay them more - they are the pits for dealing with0

This is TYPICAL of the underhanded techniques used by MBNA.
They are trying to frighten you into parting with more money than you can afford.
DO NOT WORRY - Whilst they have the right to pass your 'debt' to a Debt Collection Agency, in this case Legal and Trade, the DCA MUST act within the guidelines laid down by the Office of Fair Trading.
Even if they do turn up at your house - they have ABSOLUTELY NO RIGHT OF ENTRY and MUST leave if you ask them to.
They can ONLY turn up at your place of work with your consent and they MUST NOT discuss your finances with other people.
Have a look at the following link, to see what your rights are:
In the meantime, please contact PAYPLAN and ask them to contact MBNA.

hi
thanks for your fast response, i have emailed PayPlan with the letter Mbna sent me today ,addressed to my case officer.
thanks a lot.0 -
A creditor isn't obliged to go with a Payplan/CCCS agreement and if they choose not to, there's not a lot you can do.0
-
Theres not a lot mbna can do either, if you go to court it will rule in your favour anyway. just ignore them. we had this with Ge but they accepted in the end. just don't speak to them or write to them, ignore completely.0

MBNA have gone quiet on me after 6 months. they still havnt accepted dmp offer but have frozen interest. My most recent statement had a line along the bottom "time is running out"

Idle threats, my friend.
The last letter that they sent to me, three months AFTER I was declared bankrupt, said that it was about time I faced up to the situation and took steps to repay the money that 'I had spent' - of the £2,800 balance, over £1,500 was made up of penalty charges.' :mad:I am NOT, nor do I profess to be, a Qualified Debt Adviser.
