Thieving robbing Bankers... [Barclays]

Hello all...!
I am currently in debt to Barclays. I owe them approx £1600 on my current account which they have transferred to their own Credit Collection Agency.
I've been trying for ages to make arrangements to repay this debt for a long time but they've really hundered me - not accepting my offers and offering me a dodgy loan of £4000 over 10 years to repay the loan...!!
I also have another account with Barclays which has always been kept in order - never going overdrawn as it is a basic cash card account.
However, I have always had my fathers pension paid into this (which is clearly shown by a DWP credit on the statement) but today the money has gone. I believe Barclays have offset this - even after agreeing that I could make a token repayment of £5 on Thursday. This was agreed yesterday.
I am also entering into an IVA with Payplan - and I have also advised Barclays of this - who really don't seem to be interested.
What I need to know is - can they offset money that doesn't belong to me? I can easily prove this with paperwork from my father.
I AM making efforts to repay the debt, I HAVE made them several offers - and to be honest, the missing hundred pound or so is REALLY going to drop us further into the mire for another week...

I didn't think that they could take DWP benefits/pensions...but I don't really know.
Maybe change the title of your thread to ask if banks can touch benefits...I'm sure you will get some good advice then.Official DFW Nerd Club - Member no: 203.0 -
They can't take the money from benefits and as you can prove the moneys not even yours they will have to give it back.Barclaycard 3800

As Whatawit says, I'm almost sure they cannot take benefit money but it is an unusual set of circumstances for you to have benefit paid into your account if you are not actually the claimant. Have you phoned Barclays and explained that this is benefit money ? Might be worth pointing that out to them. You could also try asking on the Benefits board as I think people there have had similar experiences.

Couple of months ago my bank nabbed £300 out of my acc as offset against a loan. left me not even enough to pay my rent. Rang up and spoke to a (insert word for female dog here) Who refused to allow it back. rang back again and spoke to (insert word for female angel here) who stated if i had bills to pa or food to buy they'd give it back....
My point being. Call them, nicely explain that the money isn't yours and that you need it to maintain your fathers wellbeing. If you speak to the female dog of the team call back there is an angel there somewhere. sounds as if setting up a parachute account with another bank may be a good idea to move your incomings and dd's to. that'll stop barclays nabbing your hard earned money. sounds like barclays know they've got their cake and eating it right now which is why they aren't taking the situation seriously.

Yes they can offest money from other accounts. I believe they can do this with money thats not yours, as it is in YOUR account, and it you would have to prove it wasnt yours.
BUT With the payment coming from the DWP, its pretty obvious its not yours and the above posters are correct, you cannot use beenfit money for the automatic payment/offset of debt -under the Social Security Act 1992No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

Thank you ever so much guys... I have sorted out a new account - this is just the transitional period.
All your advice is much appreciated - especially the last bit quoting relevant legislation - nothing better than quoting Acts and Sections at them on the phone. They haven't a clue and you sound very clued up. lol
Also - female dogs at Barclays?! LOL Never!
