BR and where I'm living

Hi all,

I've got my BR papers from the court and before I fill them in I need some advice. I'm currently living at my girlfriends house, which she owns (except for her mortgage) and need to know if there will be any repercussion of my BR on her and her property - ie, credit rating, bailiffs, etc.

    Hi Rich,

    Credit ratings relate to people and not addresses so you shouldn't have any problems there. As for bailiffs, unless you've got county court judgements and enforcement orders against you, again there shouldn't be any problems.

    When you say that you live with your girlfriend you need to be certain that you can demonstrate that is is her house, and not jointly owned but in her name only.

    That's kinda what I thought after reading some of the other threads on here, I just wanted to double check. The house is totally in her name (bought it less than 2 years ago) so that shouldn't be a problem.

    Rich,

    The only time that she would be 'linked' with you is if you have EVER applied for finance or a utility in joint names (Im assuming you dont have any joint loan or credit facilities) .... Its this that will create the 'link'.

    Just a couple more questions:
    1) as I'm living with her I've been giving her money every month towards household bills, etc. As the utility bills are in her name, I can't prove what my outgoings are on my SOA for those bills if asked to. Is this a problem?
    2) should be be declaring the money that I give her towards the bills? and if so any ideas for working around this?

    Hi Rich,

    You need to be really careful here otherwise you could face having the O.R making a case for an Equitable Interest in the house. It may well be a case of having to bite the bullet and take legal advice from a solicitor specialising in insolvency; look out for free initial consultations and you may qualify for legal aid if you're on a low income.

    If that's not an option then I would suggest putting a figure of say £300 per month towards all the additional costs of you living there. Emphasise that you've made no contribution to the upkeep of the house or any contribution to the mortgage.

    Thanks Rich S for the advice.
    I'm on a really low income at the moment as I'm essentially an assistant/trainee to a trades person. So I only contribute £100 a month to the bills and nothing to the upkeep and mortgage as that's all I can afford. In April I earned £550 before tax, in May I earned £750 before tax and NI so I'd guess I class as low income.

    I'm curious to know what others think to.

    Hi Rich,

    I'm in pretty much the same boat. My boyfriend bought this house 6 years ago, I moved in about 3 years ago. I briefly paid about £400pm to him whilst I was working but I stopped that about a year ago when I went on maternity leave.

    I spoke to the OR (I rang the helpline and spoke to someone lovely) who basically said that it's very unlikely I'll be seen to have an interest but no one can promise anything. I figured it's probably worth the risk - I'll let you know how it goes!
