Hi,
After some advice please just had a doorstep agent from motormile finance caught me unawares on my doorstep never received any calls or anything prior to this,
The debt is for £3431.79 and the account date was for car finance
for a car that was voluntary surrendered.
they say on the letter
the ccj was recorded on the 31/07/2002
They also say the last payment was 15/03/2006.
I don't even remember making any payment in 2006
Now can anyone advise what my next move should be

Hi
Were you aware of a CCJ for this debt?
Have you seen a copy of the county court judgement?
What did you say to the doorstop agent? Did they try to get you to pay them then? Did they hand you the letter you refer to?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

Hi,
Guys thanks for the reply the guy at the door handed me a letter
he asked me what could I pay I said the most I could offer if I wanted to anyway would be £10 per month as I was out of work
He didn't take any details of cards or anything
But I don't want these people turning up again
he handed me a letter I explained the car had been voluntarily surrendered over 6 years ago and he said you are still responsible because I was ccj he did not have copy of ccj to show me
Thanks in advance0 -
Does the letter mention the CCJ? or did the agent mention a CCJ?
First you would need to find out whether there ever was a CCJ.
You might also write to the address on the letter with the template letter to stop them from visiting your property again -
To doorstep collector,
Please be advised that I will only communicate with you in writing.
Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.
There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.).
Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.
Yours faithfully,A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

The letter does mention a CCJ but this is the first I knew about it
the ccj was recorded in 2002,never had any calls or communication from anyone least of all motormile
surely they cant pursue the debt after this time

If there is a CCJ then they can pursue the debt even after this amount of time. And they can keep writing to you to ask you to pay.
As its more than 6 years old they would not be able to take enforcement action (such as instructing bailiffs) without first going back to court to try to obtain permission from the judge. And they would not necessarily be given permission.
I certainly wouldn't agree to pay anything without double checking that there definitely is a CCJ for the debt and getting a copy of the judgement (from the court). You could write to your creditor to provide details of the judgement (which court it was obtained at and the reference number), or you could try contacting northampton court with your name, address and the date you have been told it was granted to see if they can trace any record of it.
Northampton court is the bulk processing centre for CCJs and if the debtor doesn't ask for a hearing at their local court this is usually the court that would grant CCJs.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Guys, can anyone help after getting that unannounced caller at doorstep I then got a call the following morning at 0745 asking me how much I want to pay I told them they were in the wrong for calling
and the guy got quite snotty on the phone I advised don't ring again
but contact me via email only.
Fast forward two weeks and got an email as follows
Message for Mr Dale Morgan. Please contact us on 01138876876 to prevent County Court legal action. Ref: M350894 MMF LEGAL DEPARTMENT
What do you reckon my next move should be
Thanks in advance0 -
These people are terrible (well at least the company they are working for are!). I have received countless emails from them threatening the same kind of things, I have contacted them via phone, letter & email & even agreed payment with them & I still get an email at least once daily telling me I will receive a CCJ if I do not respond. My question is where do I stand after responding countless times in different ways if they choose to ignore it?! Seem like a bunch of amateurs!0

Hi everyone. I need your help. Ive been receiving these emails every few days, the same message in each. I have had no calls, or letters, as i now live in Dubai. The address is my parents address, so very scared that people will turn up at there door. Is it best to just email them back stating im no longer living in the country? and i will deal with payday direct? Does an email even serve official notice!?

First of all, remove your private information.
Do you owe the debt? Do you have the means to settle it? Is it a recent debt, or a very old debt? These will help people give you advice on how to handle it, but in the first instance, email them back stating that you are not resident in the UK anymore, and definitely not at that address. Some days, it's just not worth chewing through the leather straps....
