Under the new system is it true they dont take into consideration what the PWC household brings in?
Im trying to advise a friend but i really have no clue.
She has a little one, is re-married and although she does not work her new husband is on a very good wage and has parental responsibility for the said child.
The father does see the child though and all is amicable. He has been paying direct to her but now wants to go via csa. She is fine with this but as her new husband is on a fair sized wage she is worried this will get taken into consideration?

no her partners income wont count, I wonder why the ex now wants to go through the csa, maybe he thinks he will pay less, but it will be 15% of his salary.0

I believe this is true as my partner is in a similar situation (long story but heres a short version!). He divorced ex and took on all matrimonial debt (stupidly!) When we met I was working full time but have since had to give up due to ill health, the debt he took on pushed us into further debt so he had to declare himself bankrupt. She has remarried had further 2 children they own their own house, husband has his own business, she has just opened up a shop and the kids walk round in designer clothes. We on the other hand live in rented acc with my 2 kids I'm on benefit, partner works full time, we cannot take out any loan or credit card due to bankrupcy and me being unemployed so partner has to do overtime to cover such things as replacing household items, car maintenence, school trips etc. But CSA are basing payments on his O/T as well as basic pay and are not looking into her lifestyle at all. Fair?? - I think not.I can only please one person per day.Today is not your day.Tomorrow doesn't look too good either.0 -
I can understand your point... no it's not fair that you are struggling... but it's also not her fault that she has a husband who earns a good wage and is financially stable.
A man has to pay for his kid, be it in money or with affection.0 -

My partner does pay for his kids, always has and always will! That is not what I am talking about I am talking about the system the CSA uses to establish how much a NRP pays. He also gives them as much love and affection as he can - thats when she decides he can see them!
It is her fault that she screws over the system though - she claimed that she and 3 kids were living with her mother and brother in a 2 bed flat when applying for legal aid for the divorce. Although truth was she was living 15 miles away with her new partner and had enrolled the kids in local school. The legal aid board asked my partner if he had objections to her claim for legal aid and he told them exactly where she lived etc but she was still awarded it. The government complain about benefit fraud yet when they are handed the information on a plate they still do nothing about it!!!!!!!!!!!I can only please one person per day.Today is not your day.Tomorrow doesn't look too good either.0 -

I totally agree with what you're saying - we pay maintenance to someone far better off than us and it grates. It really !!!!es us off sometimes.
The only thing you can do is try to be less bitter - it isn't worth it. He wont have to pay forever.0 -

It's just so infuriating it feels like you're banging your head against a brick wall. I am not a bitter person but my partners ex has done some really nasty things over the 7 years we have been together and I have silently sat back and bit my tongue but this decision will financially cripple us and my kids will have to suffer through it, even though their father helps me as much as he can. So I am sorry if I sound bitter and twisted but knowing what evilness she is capeable of this is the straw that has broken the camels back, so to speak.I can only please one person per day.Today is not your day.Tomorrow doesn't look too good either.0 -
I agree with you aussiesbird! We have to pay maintanece for a child who clearly sees none of it. The child never looks nice so i have clothes here and yet child always talks about latest gadgets pwc has purchased. Its highly frustrating knowing the money we pay is making no difference to the childs life but the pwc seems to be having a right old time with it!!
Anyways thanks for your info i shall pass it on. He wants to go through csa as he wants to deal with it through a third party just incase in the future any disputes about money come up he is fully covered and knows he is paying the right amount etc. I think csa say he has to pay £1 more a week so he's not trying to get a reduction by going to them he simpyl wants to cover his back, no-one knows what the future may hold and my friend is cool with all this, she knows he will support his child no matter what, she was just worried she would see none of it they took into consideration her household income.

Sounds exactly like my partners ex!! Using the kids as pawns for money and denying access when it suits her!! We endured a major court battle for years only stopping when csa changed rules and she realised she would get more money so let us see child again! Sick!!0
