JSA - why cant my girlfriend claim?

    Not sure it would make much difference where she lived. If she lives at home then her parents would be expected to support her surely and if she lives with you then you'd be expected to support her?

    If hse lives with her parents then they wouldn't be expected to support her and she would be entitled to income based JSA.

  • To answer a few questions...

    Financially everything is in my name. Mortgage, phone, everything. She does not contribute to the costs of the house at all because she doesnt live there, just spends lots of time with me there.

    Electoral role she is still at her parents house.

    Clothes wise... my house is not big enough for all her clothes! Most of them are at her parents house still, but she has got lots at mine.

    I will ask her to appeal against it and see what they say. It is a strange situation... I spend half my life at sea so she is not at my place while I am away, but when I am home she is always with me. I think she put my address down because she filled the forms in there.

    She put your address down as where she lived? Then they are bound to consider you a couple as she told them she lived with you! Seems to me from what you have said that she actually does live with you, and goes to stay with her parents when you are away so she is not "home alone". Seems fair therefore that your income is considered together and you have to support her whilst she is not earning.
  • Thanks harrys dad... As I say it is a strange one. Never even considered that they would think I am supporting her. Odd that if she lives with me I am meant to support her, but if she lives with parents they aren't.

    Anyway, if she doesn't fit the criteria then so be it. We will manage, and I should imagine soon enough I will be giving her keys so she can live there without me. Hopefully she will soon get a job too!

    Thanks for everyones replies, you have confirmed that job centre are right... thought they would be they are only human and could make mistakes. No sense appealing it really, and besides, there are no doubt better ways our taxes can be spent on folks who need it more.

    PS. She is a Russian translator, not many openings going for that!
  • Why has she put your address down as being her address then? You wanted to know what you could do and now have a good reason to appeal it and you are now not bothered?

  • Funky bold ribena... she put my address down because thats where she will be moving to full time soon enough so thought rather than change it in a few weeks/months (hopefully she wont need JSA then) she put my address as she is there half the time anyway.

    If we knew how the system worked she would have put her parents address, it is just as much her home as my house is her home at the moment.

    I appreciate everyones answers. I will discuss with her when I get home and see what she thinks...

    Seems strange as they never asked my income. I will get her to look in to the NI credit thing and I imagine there will be something to help with council tax too.

    The system seems nuts to me but then I suppose I dont know enough about it. Shows like that 'skint' just make me think why can some folks live on benefits all their lives, but when a normal hard working person needs help they cant get it! But I am sure that is the minority.

    Surely you can see that if she was actually living with you then it would be completely fair to expect you to support her, rather than taking money from the state so that you don't have to? Looking after each other in times of need is what couples do and its something they should discuss when they decide to move in together.

    If she's not actually living with you, then she needs to make that clear to the job centre and change the address she's given them. You'll need to be careful about how often she stays with you though to avoid potential fraud investigations. Pretending not to live together in order to claim more is one of the most common methods!
