HI posistion on the 'working hours' is that as he will be in a hotel doesn't count and the advice on CAB was fuzzy as it states "The CAB says if your employer says that you have to stay in a certain place when you are on call, then all the hours you are on call will count as time at work. This is still the case even if you're allowed to sleep when you're on call." but doesn't define the type of place.

They are however infringing his rights by

A. Not allowing him rest days in lui but making him continue his normal working pattern and

B. Not allowing him an 11 hour 'undisturbed' break between shifts.

Good to know, although the problem is his employers won't really care. However, he will mention this if they try and 'bank' his hours to make sure he is paid fairly.

If this is a one off because if it is then IMO your OH should suck it up, if its a regular occurrence then its worth fighting a bit.
