Partner with CCJ

Hi, I have recently married my partner and she has a CCJ.

A couple of years ago when we were just dating, I got a mortgage with Santander on my own which was no problem as I had a good rating.

Now that we are married, can I still remortgage on my own or will it mean I cant because of her bad credit?

I think there will still be a few more years until we can get a mortgage together when her CCJ is older than 6 years

    Do you have any joint financial commitments or accounts, such as credit or current account?

    If you do, this may present a problem even if you remortgage to a new lender in your sole name.

    If not, there should be no problem. She will simply sign a consent to mortgage form as an occupier.

    How much was the CCJ for, the date of registration, satisfied, reason? What's the loan to value of the new mortgage?

    Hi Thanks for your reply.

    We do have a joint bank account, should we stop that before remortgaging in a couple of months or is it too late?

    I also have a cashback credit card which she has a card for.

    The LTV is 70%

    The bad credit is all in the past now as she has cancelled credit cards and has a small loan she is paying off.

    The default was in July 2008 for a small amount on a store card, but after moving house it wasnt noticed and settled until July 2010.

    There is another defaulted account in December 2010 settled January 2011.

    I've also counted about 20 late payments in the last 6 years of cards / loans.

    So, that's two defaults, what about the CCJ?

    The devil is in the detail. Is there any chance you could actually give specific answers;-

    Default dates July 2008 & December 2010
    Amounts £ & £
    Settlement/satisfaction dates July 2010 & January 2011
    Reasons?

    Are these issues shosing on all three versions of her credit file, or just one or two? If you can't answer this, obtain the credit files from the CRAs you don't have;-
