I am in the process of leaving my job as, once my car died, the travelling is nearly 2hrs each way, and I am exhausted/getting ill a lot/tearful/etc, etc. I do not have anything permanant to go to yet, as the job I thought I was getting fell through. I tried to retract my notice but was told I couldn't. I do not feel that I am in the right physical or mental state to be getting a permanant fulltime job again at the moment, so I am looking for something either part time or temping. I feel that the only alternative to this would be to get myself signed off 'sick' and go onto benefits, but I don't want to do that, I want to work (I have never claimed a penny and have no intention of doing so when it is not 100% necessary) just I need to be able to work within my limits.
What will be the courts view on this? Am I better to just get into a routine of sorts before I go for bk, or do it straight away? It sounds daft, but I am really scared I will be sent to prison for leaving my job! I am not sleeping and am constantly feeling ill, every morning just getting out of bed is hard, and I feel sick half the time - I think if I didn't leave my job now they would be sacking me soon, and I am never in trouble, never have been before, even at school.

The court or the OR will NOT judge you.
You have explained very well why you are taking the steps you are, and the OR will be sympathetic as well.
They do NOT have the power to tell you when/where/how you should work.
I know it's difficult not to worry about all this stuff, but please believe me that you will be OK.

You are not going to get sent to prison for leaving your job. Yes you will probably get asked why you have left your job but the OR can be quite reasonable so I'm sure you can explain the situation.
It may be worth going to see your doctor even if you are not going to go on the sick.BSC Member 59 - AD 29th March 2008

I agree with Red, I think you should go see your GP rufus. BR can be extremely stressful and at times like these you need all the support you can get. Even if you had to be signed off sick and live on benefits it would only be a temporary situation, and it would give you some time to recover, get the BR out of the way, and then you'll be in a position to start looking for work and rebuild your life.

I am going to try to avoid going to the dr - once this is all over, and i'm discharged, and I'm able to get on with my life properly, I am hoping to do something that I need to be certified physically and emotionally well for - but if necessary I will. I am just all panicky (as you can tell
) and sort of wanting this done and dusted, and sort of still scared of doing it.
Also, I still have some money in the bank (nearly £3000 actually) that I had been saving to try to pay off my iva early. Will I be told I shouldn't be going bk when I have money there? Part of me thinks, blow it, I'll take it out and use it for 'living costs' but another part thinks I want it to go to my creditors, esp as I have reread my iva paperwork and can see that not a single penny will have gone to them yet - my first 2 years payments all go to the iva company!!:eek: I am quite stunned by that.0 -

I'm not sure you'd get away with withdrawing that amount of cash and the OR not noticing. However, I'd definitely take some of it out for living expenses.BCSC Member 70:j

I agree. Simply looking at your SOA will tell them how much your living expenses are for the month, so £3k suddenly disappearing from the account isn't going to be easily accepted. I'd take out whatever you would normally spend in a month, then it's less obvious what you've done.

Can you not use some of the funds (say £1000) to get a runaround vehicle-say £800 and insure it/tax it for the year. You will NEED this vehicle to look for work, visit elderly relatives, doctors appointments etc Due to the nature of your depression (do see a doctor) you will need more flexibility in your working and a car will allow this.
Then you can withdraw the majority of the remaining funds (start now, dribs and drabs)to set you up, whilst you have no income/bank account and whilst you see whether you will actually find work, or whether you will claim benefits. As you future is so uncertain you will need as much cash as possible. Wages from temping will take ages to come through, likewise benefits are not quick (can be up to 6 weeks) so you WILL NEED as much money as you can lay your hands on. In the event that you receive no benefits/income for 6 weeks you will have receipts for rent/living expenses etc.
Don't be scared.

I really do see going to the drs as an absolute last resort - I do not want to be signed off, nor do I want antidepressants - I am not depressed, just stressed and overwhelmed, and need time to recover and get myself together - working part time will also allow me to get to church far more often which will do me far more good than any pills will.
I hit the supermarket big time at the weekend, and will probably do the same at least once or twice more before the bk actually happens - I guess if my bank statement shows a payment to Sainsburys they can't expect me to repay it? (got some very nice brandy actually;) ).
I am going to some agencies tomorrow to see about work, but I am planning to have a week at least at home before I start work - I need the time to get all my paperwork/ststements/etc organised.0
