I am currently on sick leave but feeling much better and wanted to return to work and work my notice for redundancy but work is saying my job no longer exsists. What do i do? I won't get sick pay as i have no sick line and i am still employed but almost unemployed due to redundancy situation. I am waiting for a compromised agreement to be finalised.
So do i just stay in limbo without pay or sick pay? This could drag on another month! I just can't afford this situation any longer.
Thanks
Leona

If your job no longer exists then you have been made redundant and therefore, you're entitled to the usual redundencyNo longer using this account for new posts from 20130

Seconded. The fact you were on sick is irrelevent. Make sure you get all holiday pay entitlement, including for the time you're on sick.
Once you've been officially made redundant, if you're able to get there, go sign on or if you're still signed off sick put in a claim for Incapacity Benefit.0 -
That's right, get the company to clarify the position straight away. Also ring Jobcentre plus to get your claim sorted out asap whether is JSA or Incapacity.:hello:0

Well i just seem in limbo if you know what i mean. I can't go back to work and they are discussing things with my Solicitor re Compromised Agreement. To be honest i don't think they want me back there to work my notice.
I have been off sick for a while but really need to get back to some sort of normality, it's not helping me being off sick and at home. So i don't have another sick line, so can't get SSP. They don't want me back to work so i'm stuck!!

Well, I'm no expert, and it would be worth talking to ACAS about this, but surely if your GP has signed to say you are fit to return to work, then work should be paying you UNTIL they have decided you are definitely being made redundant? Even if they don't want you on the premises for whatever reason ...
You're saying it's not helping being at home: it's unclear whether you were on full pay while off sick or getting SSP. If it's the latter, I'm just wondering whether the thought of having to pay you your normal wages would concentrate their minds somewhat.
If that makes sense ...Signature removed for peace of mind0 -
Thanks Sue
I have received a letter regarding my redundancy payment but it's not giving me any holidays.
I was off sick due to stress related work problems from November - i have calculated that I should be due 21 days from last year as I hardly had a day off. From 2007 I have 8 days. Our holidays run from April to April.
Sounds like I am not getting my holidays as I was off sick! But my god being off sick was no bloody holiday to me!!!

Again, something to check on the ACAS site but as long as you have not been off sick for a full year you do still accrue holiday pay and I think that means it should be added to your redundancy!Signature removed for peace of mind0
