Hi there.

I've been at my current job for just over five years. I was full-time until I returned from maternity leave in January. I now work three days a week (9:00am to 5:30pm).

For the past month or so, my team have been particularly busy and a few people have been staying until well past 5:30pm to complete urgent tasks at the request of our (new) manager. I have stated on more than one occasion that I am willing to do this myself but I must have enough notice to arrange for someone to look after my daughter first (my husband doesn't finish work until about 10:00pm usually). I can't just let it get to 5:30pm and then agree to work late as most other people do.

However, today it got to 5:25pm and he TOLD me to stay for another couple of hours. I explained that I couldn't as I needed to be at home with my daughter. It was too short-notice to ask someone else to pick her up from nursery and take her home etc. This is the fourth time in two weeks that a similar thing has happened. I always ask in the morning if he wants me to stay a bit later than 5:30pm but the answer is always "no" (until I'm literally about to walk out the door!).

My manager sent me a text an hour ago saying how frustrated he is with my "lack of teamwork" and will be referring me for a disciplinary hearing next week. Can he do really do this?! :mad:

    Of course he can,

    It is how it is handled if it is taken seriously that you need to consider.

    Whats in your contract relating to over time and flexability


    An alternative.

    Every time you ask they just say yes we need you for two hours and then change there mind at end of day and you go home on time.

    ask at the latest time it would be possible to arrange alternative cover not when you get in.

    It must be fairly obvious when the workload needs overtime.

    In your hearing, don't forget to bring up his lack of professionalism by texting it to you at 9pm instead of dealing with it in the office, as expected of a manager.
